Alan Thicke widow scores a victory over Robin and brother

Tanya Thicke scored a victory in court today against the co-trustees of her late husband’s estate, her sons Brennan and Robin.

From his courtroom in downtown LA, Judge Clifford L. Klein ruled in favor of Tanya after her attorney Adam Streisand said that she was NOT going to challenge or try to overturn her prenuptial agreement.

‘Then this is a case without a controversy,’ the judge told the lawyers representing both parties, ‘I’m going to dismiss the petition without prejudice, meaning, if you have something specific, the door is open, we can address it at that point.’

Robin and Brennan Thicke filed legal papers in their father’s probate case in May to stop what they alleged was an attempt by their step-mother to get more than was granted to her in the prenuptial agreement she signed 12-years ago with their father Alan Thicke.

Under the terms of her prenup, Tanya was set to receive $500,000 from a life insurance policy, 25% of her husband¿s personal effects, all of the furniture at the ranch, all death benefits from Alan¿s pensions and multiple union memberships, and 40% of the estate after certain bequests were handled. In court papers they say Tanya threatened them with negative press if her demands were not met.

Tanya countered that the men (co-trustees of Alan’s 1988 living trust) were simply upset that she would not allow them to turn part of the family’s ranch into a ‘pot farm.’

She quickly fired back with the motion to throw out their lawsuit.

Brennan and Robin’s attorney Alex Weingarten referenced a privileged three-page letter that his clients had received from Tanya. Specifics of  her alleged demands regarding Alan Thicke’s estate were not available.

Tanya’s lawyer Adam Streisand told the judge, ‘In the grand scheme of things, this is a small estate. We should not be wasting the beneficiaries money.’

Weingarten referenced a dispute about a 5-acre parcel of Alan Thicke’s Carpinteria ranch that had been earmarked for Tanya but he wouldn’t give specifics. There was also mention of possible mediation to work out details of the trust.

The hearing was vindication for Tanya, who said all along, she was not challenging her prenup.

Afterwards, Tanya’s attorney Adam Streisand told the DailyMail.com,  ‘We’re glad the truth is finally coming out, [Tanya] has been maligned.’

On September 4, Tanya posted then deleted a message on her Instagram account, “The truth always prevails. I can’t wait to put this all behind me.”

It has been nine months since the world lost TV’s favorite sitcom dad Alan Thicke to a heart attack at the age of 69.

Thicke collapsed on a Burbank ice rink while playing hockey with his youngest son Carter, 20, on December 13, 2016.

The Growing Pains star was transported to nearby St Joseph’s Medical Center where he was pronounced dead from a ruptured aorta.

He was laid to rest a week later at the Santa Barbara Cemetery, just eight miles from his beloved 11-acre ranch in Carpenteria, Ca.

At the time of his death Alan was worth an estimated $40 million.

Alan’s sons received an equal share of his estate and ownership of the ranch under the terms of the living trust, which was initially drafted in 1988, and updated over the years, most recently in February of 2016.

Bolivian born former model Tanya Callau, 41, met the husband she adored in 1999 at an event in Miami, Fl. The two married in a lavish beachside ceremony six years later in Cabo San Lucas, Mexico.

It was Alan’s third trip down the aisle. His first was a fourteen year marriage to actress Gloria Loring, 70, which produced two sons, Brennan, 42, and ‘Blurred Lines’ singer Robin, 40.

His second marriage was to Miss World America Gina Tolleson, 47, the mother of Carter.

Things seemed to be going well for the blended family, especially when they appeared in the reality-sitcom hybrid “Unusually Thicke” in 2014.

But it appears that Carter, who was a main ‘character’ on the show, is now on the outs with his former stepmother, and siding with his older brothers.

On September 5, he posted a poignant photo of himself at his father’s ranch riding horseback with his mother Gina.

“Missing my home. I’ll be back soon. The truth always prevails, right?”
