Audio recording has Law and Order actress Diane Neal declare that she’ll kill her magician ex

Actress Diane Neal threatened to harm her former partner – magician JB Benn – and kill her pet dog, according to a new audio recording featuring the couple.

The recording was shared a day after former Law and Order: SVU actress Diane Neal filed an amended complaint against her former partner.  

She criticizes Benn for ‘having no friends’ while also telling him that she will ‘murder’ her dog by shooting it in the head. 

Sources familiar with the exchange say that Neal was on a muscle relaxant called Flexeril, which she is said to take on a semi-regular bases.

Neal had been taking the drug for a back injury she suffered while in a car accident in 2013, the source explained to the Daily Beast. 

A nine-second video of Neal from that night that Benn allegedly took shows the actress slurring in her speech while in bed. 

In a statement, Neal’s lawyer – Sarmad M Khojasteh – said that the tape ‘offers a heartbreaking glimpse into the tortured existence Ms. Neal endured at the hands of Mr. Benn.’

He added that Benn released the audio ‘solely to distract from the the allegations of physical and sexual assault against him, which are corroborated by witnesses and photographs, and from the fact that he was arrested for stalking Ms. Neal in the last six months, pled guilty, and currently is under an order of protection prohibiting him from contacting her.’

According to the Daily Beast, the audio was not submitted by Benn.   

The recording was likely taken on the Apple VoiceMemos application on November 7, 2017, at approximately 7.33pm. It was uploaded onto iTunes the next day.

It starts mid-argument, with the two bickering over Benn’s refusal to give Neal his cell phone passcode. The conversation quickly turns to real estate. 

‘Do you think doing manual labor on a house that doesn’t belong to me and spending my own money and all my f*****g time and all my f*****g energy doing that is f*****g helpful to me?’ Neal asks. 

She continues: ‘Is it helpful for someone like that to be treated like s**t for four years? For you to start s**t with everyone I f*****g know? For you to isolate me? For you to be a prick and then spend my f*****g money on your f*****g house and you to be such a selfish prick? I’ve never met your f*****g parents and I don’t know your f*****g cellphone code? Is that helpful?… Do you think there would be self-esteem building for anyone?’

When Benn says that the two will break up, Neal begins shouting about how she will make his life ‘miserable.’  

She shouts: I’m going to kill you—or I’m going to sue the f**k out of you. I’m going to make your life as miserable as you’ve made mine. The difference is that unlike me you have nothing to lose. Because your life is this big. Your life is this big! You have no friends, you don’t do anything, nobody loves you. You have no family. You don’t have anything to lose. Me? I’ve already lost everything. I have now nothing to lose. I’m going to f*****g take you down with me.’

Neal then tells Benn that she plans to kill Charlie the dog. 

‘I’m going to kill him in front of you,’ she states before changing her voice to sound more singsong like. ‘Charlieeee I’m going to kill youuu… I’m going to shoot you in the head in front of your daddy so that your brain goes all over him! Maybe, just maybe, then you could illicit some sort of emotion from this f*****g android.’

Neal reportedly asks Benn if he wants to die by fire or carbon monoxide, expressing her bitterness that she spent $100 on detectors that he never put up.  

‘F*****g you deserve to die,’ Neal declares. ‘You want to be Peter Pan? I’ll kill you before you get f****g old motherf****r… You saw me doing what I f*****g love, and you took it all away.’

The actress continues berating Benn, telling him that he is the ‘least fun person’ she has ever met.

Neal wonders what would happen if she killed Benn and how long it would take for other people to find out.  

‘How long would it be before anyone knew you were dead? Until your next gig. And then I would call them up and say you were in the hospital or something,’ she says. ‘That would buy me a few more months. Yeah. Okay. How long until the parents figured it out?’

Benn claims that he will ‘work on getting better tomorrow’ but Neal asserts that she will kill him before the sun rises.

The series of damning accusations centers on claims Benn, who she met in December 2013 at Robert F. Kennedy Jr.’s annual Deer Valley Celebrity SkiFest fundraiser, pushed Neal out of a $529,900 home she in part paid for.

Her claim states: ‘At the time, the parties agreed that Benn initially would take title of the property under his name alone in order to avoid complicating issues related to Neal’s divorce, then add Neal to the title once those issues were resolved.’

Benn, who denied all charges in an earlier version of the complaint, argues Neal had simply helped him look for the upstate home, which he owns. He said that Neal ‘will say whatever she believes is necessary to gain sympathy and to support her ongoing vendetta against me’.

But she alleges the magician ‘defrauded her of millions’ and ‘violently inflicted emotional distress’ on her via ‘a campaign of isolation, terror and (physical and sexual) assault, and destroyed her reputation by doing so’. 

Her complaint claims: ‘As a result of Benn’s depraved and unconscionable conduct against Neal, and his attempts to continue the campaign of terror and intimidation against her, Neal—fearing for life and her safety, and at great personal cost—has been forced to live in hiding rather than pursue her professional career.’  

Neal also claims Benn pushed her out of an upstate New York home she says the pair bought together before their March 2018 split and hurt her pets, allegedly slashing her dog’s throat and then blaming her cat. 

But Benn, who counts singers Sia and Moby among his fans, said in an earlier rebuttal that the accusation of sexual assault is ‘completely false and outrageously interposed as a tactic to cloud the fact that, on the merits, [Neal] has no entitlement to the relief she seeks’.  

Benn said: ‘I fear that as this lawsuit progresses, [Neal’s] accusations will grow increasingly outlandish, and will be even less tethered to the supposed matter at issue here—the ownership of the [upstate] property.

‘The only thing that [Neal’s] papers prove is that she is so beholden to her anger over our failed relationship that she will swear to anything, without regard to the truth, to paint me in a false light and to try get [sic] from this court what she wants.’

The fresh details have emerged after Neal spoke with The Daily Beast, telling the website Benn would not relay messages from missed calls with friends or tell her loved ones she was suicidal, homicidal, and an alcoholic.  

Pictures show celebrity favorite Benn, who pleaded guilty to disorderly conduct Wednesday after he was arrested by state troopers for misdemeanor stalking, with Robert F. Kennedy, Jr., recording artist Miranda Lambert, actress Cheryl Hines and actor Jason Alexander.

A testimonial on his website from Moby reads: ‘I’ve seen JB do magic at least 250 times and each time I’m just as stunned as the last. Some of his magic shouldn’t be possible, and it makes my brain hurt in the best possible ways.’

Sia adds: ‘The most spectacular magician I’ve ever encountered!’

Neal, who ended up running unsuccessfully for congress when Benn ‘had her blackballed’, said the initial stages of her relationship with Been was ‘romantic, sweet and simple’. 

But by August 2017, Neal says ‘Benn instigated an argument with Neal, then violently assaulted her, repeatedly kicking her. Benn left Neal bruised on the floor.’

Her complaint adds: ‘In early 2018, while Benn was traveling, Neal discovered documentation in Benn’s home office in the [upstate] Hurley Residence that revealed that Benn—without Neal’s knowledge or consent—had fraudulently transferred monies from her bank accounts, stolen her personal checks, and used her credit-card accounts to pay for his personal expenses.’

It goes on: ‘Unbeknownst to Neal, Benn – in order to ensure he could continue to perpetrate his scheme to defraud her of the millions of dollars of lifetime earnings – was actively and deliberately isolating Neal from her friends, colleagues, business manager, managers and agent.’

Neal’s complaint alleges woke to Benn sexually assaulting her in March 2018.

Attorney Khojasteh told The Daily Beast: ‘Ms. Neal has suffered a devastating ordeal—as a victim of domestic abuse that robbed her of her personal security, as a victim of a fraudulent scheme that robbed her of the financial security that she earned during an extremely successful acting career, and as a victim of lawyers and prosecutors who have served her extremely poorly.’
