A pervert has avoided jail time after claiming the child porn he was caught with was a ‘distraction’ from his loneliness. 

Police found 78 images and two videos of child pornography material on David Wayne Bell’s laptop after searching his home on March 21, as reported by The West Australian. 

Bell plead guilty to the possession of the material on Monday after which he was sentenced at the Bunbury District Court and listed as a reportable sex offender.

Defense lawyer John Mazza said Bell’s use of pornography was a ‘distraction’ from the ‘sense of loneliness’ he felt in his life. 

He also added that Bell had never contacted children with sexual intentions and accepted full responsibility for his actions. 

Mr Mazza mentioned Bell is highly remorseful and intends on seeking professional help on this matter. 

The court was informed that Bell had told a psychologist he was extremely ashamed and horrified by his behaviour. 

Although State Prosecutor Zoe Jenkins described the market for child pornography as ‘contemptible’ and ‘despicable’, she was not opposed to a suspended sentence given Bell’s absence of previous convictions and his effort to seek professional assistance. 

Judge Simon Stone said Bell had numerous references who spoke ‘well’ of him and his overall character.

Judge Stone said he was satisfied with Bell’s remorse and believed in his ‘prospects’ for rehabilitation. 

Bell’s sentence included a 12-month jail term which was conditionally suspended for 18 months.
