An underqualified carer has avoided jail after pleading guilty to sexually assaulting an intellectually disabled boy she was supposed to be looking after.

The 28-year-old woman was caring for the 15-year-old on August 18 last year when she sexually abused him at his home.

The woman was given an intensive corrections order of 22 months earlier this week after ACT Supreme Court Chief Justice Helen Murrell took her violent and abusive upbringing into consideration.

The boy’s usual carer was unavailable so the woman collected the boy from school before taking him home to play video games.

They began touching each other over their clothing while watching a movie, the court heard, as reported by the Canberra Times. 

The woman then took off her clothes and allowed the boy to digitally penetrate her, as well as rubbing the boy’s penis.

The woman reportedly said to the boy that what happened was their ‘little secret’ and not to tell anyone.

His mother found out what was happening after her son had been acting unusual.

She told the court her son had put a toy gun to his head and said ‘I hate my life, I want to die’.

He initially refused to tell his mother what occurred saying, ‘I don’t want to tell you because I’m scared I’ll get into trouble. It’s really bad. I don’t want to go to jail.’

The boy’s mother rang the police that evening after he eventually confessed.

In a victim statement, his mother said he suffered feelings of fear, sadness and guilt about the incident.

Chief Justice Murrell said because of his disability, the boy would struggle to understand what happened.

‘Any child is deemed unable to give meaningful consent to sexual activity, a circumstance which is aggravated in the case of an intellectually disabled child,’ she said. 

The carer’s childhood was taken into consideration as the court heard about the horrific treatment her and her siblings were subjected to by their father.

The court heard that her father had raped her and also told her and her siblings to perform sexual acts on one another while he watched.
