A female prison guard and a cop killer who are alleged to have had sex behind bars won’t face charges if their supposed tryst is proven to have taken place.

Murderer Sione Penisini and guard Amy Connors were under surveillance for more than a month before Corrective Services swooped in and suspended Miss Connors.

While Miss Connors will likely disciplinary action if the investigation finds against her, neither her or Penisini will face criminal action as the relationship would not be illegal.   

Penisini, who was jailed for 36 years in 2002 for murdering police officer Glen McEnally, was transferred to Goulburn Supermax prison after officers took action.   

Mr Elliot said the allegations were not a criminal act but ‘it is a breach of the code of conduct’ for Corrective Services staff. 

The Daily Telegraph reported that Mr Elliot’s office will now look into ways to prevent sex between corrections staff and prisoners. 

Police Association president Tony King has slammed Mr Elliot and Corrective Services Commissioner Peter Severin after the allegations were made public and said it should never have happened. 

‘If Elliott and Severin were doing their jobs, every cop killer would be rotting away in Supermax, it’s a direct slap in the face of every officer, all of us who have worn the blue shirt,’ he said.

It’s also reported that Miss Connors attempted to tender her resignation after being suspended on Friday but it was denied because Correction Services wish to complete their investigations first.  

Mr Elliot is set to visit the Kempsey jail in the coming week and said he had spoken to Constable McEnallay’s mother and expressed his sincerest apologies that this could happen. 

‘It is clear this inmate should never have been alone with a junior female officer. I am keen to see what options we could implement to ensure this is never allowed to happen again,’ he said.
