Former Household Cavalry soldier, 42, faces jail after he was spotted swerving across a road while five times over the drink-drive limit

A former Household Cavalry soldier is facing jail after he was caught more than five times over the drink-drive limit.

Malcolm Livingstone, 42, was spotted swerving across the road in his Nissan Almera before hitting a kerb and pulling into a supermarket car park in King’s Lynn, Suffolk, on August 5.  

Police arrived at the scene and Livingstone, also an ex-RAF sniper who saw ‘significant frontline action’ in Bosnia, Kosovo and Iraq, was arrested after refusing to give a roadside breath test. 

While in custody he blew 169 microgrammes of alcohol in 100 millilitres of breath -the legal limit being 35.  

Livingstone, of Suffolk, pleaded guilty to drink-driving at King’s Lynn Magistrates Court on Thursday. 

Andrew Cogan, defending, said: ‘Far from denying he had been drinking, according to the arresting officer, when he was asked if he’d had a drink, he said ”Yeah, one beer after work”.’

The court was told that Livingstone had until recently been in the Household Cavalry and had previously served ‘at the very front of the frontline’. 

Mr Cogan told the bench: ‘You can understand the effect that’s likely to have on him in later life.’

He highlighted Livingstone’s previous unblemished character and asked that they consider imposing a suspended sentence.

Chair of the bench Julie Costley replied: ‘We haven’t ruled out custody at this stage.’

The case was adjourned to next month to gather references. 

Livingstone was given an interim driving ban and released on unconditional bail.
