Empire actor Jussie Smollett is demanding that a $130,000 lawsuit filed by the city of Chicago following his alleged hoax attack be thrown out.

Smollett has asked a judge to dismiss the lawsuit because he insists he is innocent. 

In court documents obtained by The Blast, Smollett notes that the criminal case against him was dropped and he maintains that he never changed his story about the alleged attack. 

The city sued the actor back in April for the cost of investigating his allegations that he was a victim of a racist and anti-gay attack in downtown Chicago.

Prosecutors dismissed charges against Smollett related to making a false report. 

But the police department and city officials maintain that Smollett orchestrated the January incident and they’re trying to recoup $130,000 the city spent on police overtime. 

‘(The lawsuit) appears to be an unprecedented effort to seek penalties and resources expended in connection with allegedly false statements made to the police where the related criminal case concerning the statements was dismissed nolle pros on all counts,’ Smollett’s recent court filing states. 

Smollett, in the court filing, also disputes the amount the city is seeking in the lawsuit.  

‘Both claims fail to state sufficient factual allegations to support a reasonable inference that Defendant’s allegedly false statements caused the CPD 1,836 overtime hours and the City paying $130,106.15 in overtime pay,’ court documents state.
