Kelly Clarkson is asking for joint legal and physical custody of her two children River, five, and Remington, four, in her divorce from Brandon Blackstock, 43, after seven years of marriage.
The Blast reports that Clarkson, 38, – who is worth an estimated $45 million – is also asking the court to terminate Blackstock’s ability to seek spousal support, and for the couple’s prenuptial agreement to be ‘enforced’ which could outline a custody arrangement.
The American Idol winner filed in Los Angeles court last week on June 4, according to documents obtained by the outlet. Meanwhile, TMZ report that Clarkson has listed the separation date between the pair as ‘TBD.’

Determining the date of separation in California divorce can be tricky, and spouses will often litigate over the issue.
If it becomes a contentious issue, the court will look for evidence that a spouse displayed any actions that showed they wished to discontinue the marriage.
Last month, Clarkson put her Encino, California home up for sale, listing the sprawling pad for just under $10 million.

Clarkson first began dating Blackstock in 2011 and married him in 2013. Blackstock also shares his 13-year-old son Seth and 17-year-old daughter Savannah with his ex-wife Melissa Ashworth.

During their chat, in which Gordon’s 13-month-old son Oscar appeared, Clarkson said: ‘Oh my gosh! Do not do this to me. I so want another child, and my husband is like, ‘No! We have four!’
‘You get baby fever when you see them and you’re like, ‘Oh, I miss the chubby little legs and the little face.’
The desire to have another baby came as a surprise to Clarkson’s fans, as she has previously been vocal about her decision to stop having children.
She even had her tubes tied to prevent her from getting pregnant for a third time, whilst Blackstock has also undergone a medical procedure to ensure he is no longer capable of having kids.
In 2017, Kelly said: ‘Oh God, those tubes are gone! That’s blasphemy. We don’t even speak of it. We’re both fixed in our own ways, yet still we’ll probably get pregnant again somehow.
‘I always feel bad because I have friends who have a hard time getting pregnant and I’m just like guys, I have the worst pregnancies ever, it can’t happen again!’
Blackstock’s father is television producer Narvel Blackstock, who divorced country singer Reba McEntire in 2015.
Clarkson and Blackstock got engaged in December 2012 and the following August canceled an October 20 wedding date, saying that they would instead elope.
However, they eventually went through with the October wedding date after all, with Clarkson gushing on Twitter: ‘I’m officially Mrs. Blackstock. We got married yesterday at Blackberry Farms in TN, the most beautiful place ever!’
However, speaking of her intense wedding planning, Clarkson told Ryan Seacrest earlier that year: ‘I’m so over it. It’s so overwhelming. We’re just doing a lot – touring, and the wedding, and the Christmas album… so I’m over the wedding part.’
In 2012 Texas native Clarkson made her home Nashville because that’s where Blackstock resides.
