Shark Tank star Kevin O’Leary and his wife Linda are seen in public together for the first time since their horrific boating accident which left two people dead, exclusive footage obtained by DailyMailTV shows. 

Linda, who was driving the boat, has escaped jail despite being charged with careless operation of a vessel over the August 24 crash in Ontario, Canada.

The O’Learys are estimated to have a net worth of $400 million. The couple share a lake house near the site of the accident. 

It emerged the 57-year-old had alcohol on her breath at the time and admitted to drinking some vodka after the crash but prior to a breath test.

Gary Poltash, 64, from Florida, and mother-of-three Susanne Brito, 48, from Ontario, were killed in the nighttime collision. The driver of their boat, New York native Richard Ruh, has been charged for driving without navigation lights.

Linda had faced a maximum 18 months imprisonment and a $1 million fine, but both drivers will now avoid jail time and instead receive marine violations and a fine.

Five months on from the tragedy, DailyMailTV spotted Kevin and Linda kicking back and enjoying a new year break on Miami Beach, Florida.

In other shots Linda nuzzled into her 65-year-old husband, who was sat next to her wearing a light blue t-shirt, dark shorts, sun hat and shades.

After a few hours the couple left the beach with a group of friends and Linda, wearing a navy halter neck summer dress and sun hat, was seen using crutches before transferring to a ‘KneeRover’ medical scooter.

Shark Tank businessman Kevin, known as ‘Mr Wonderful’, helped carry the scooter up the sand and on to a nearby pathway.

As cheery Linda wheeled herself down the path, she raised her right hand in mock jubilation.

It’s unclear whether mom-of-two Linda’s injury is related to the boating accident or something more recent.

The group walked to a nearby Tiki Bar where they continued the fun day.

Police previously stated that Linda was not drinking or taking drugs at time the accident occurred, but documents obtained by CBC News in Canada revealed that she ‘was administered an alcohol screening device test (after the crash) and it registered an alert’.

Linda vehemently denied she drank alcohol before or while steering the boat, with the document stating that ‘she claims to have consumed a drink of vodka following the collision but prior to the breath test’.

She reportedly does not remember who handed her the alcoholic beverage in the aftermath of the crash.

Linda’s lawyer, Brian Greenspan, had told CBC that his client was not intoxicated at the time of the crash and that the accident ‘had nothing to do with alcohol’.

Ontario Provincial Police charged Linda with ‘careless operation of a vessel’, but as it is not a criminal charge, Linda will not face jail time if found guilty.

In November last year the family of Susanne Brito filed a wrongful death lawsuit against the O’Learys after learning that Linda would avoid jail.

Brito’s parents, Rosa and Antonio Ragone, and sister, Paula, are seeking punitive, exemplary and aggravated damages for wrongful death.

In a news release, the family’s attorney Patrick Brown, of McLeish Orlando LLP, said: ‘For this grieving family, it is about obtaining civil justice so as to prevent these types of deaths and curtailing reckless and dangerous behavior from continuing on our lakes.’

‘Our family has lost a beautiful, loving person. We are devastated,’ Brito’s mother Rosa said in the release.

‘We sincerely hope that through this process, that justice is served and that steps are taken so that innocent victims like Suzie, are not seriously injured and killed and that other families do not have to go through such pain and loss,’ she added.

Authorities said Poltash died instantly when the O’Leary’s smaller vessel crashed into theirs and struck him in the head.

Brito suffered severe injuries and died two days later in a hospital.

A source connected to the owner of the larger boat claimed that O’Leary’s boat fled the scene after the collision, but a rep for the Shark Tank star said that it was the other boat that left the scene.

O’Leary’s rep went on to say that his wife was administered a DUI test after the accident and passed it.

In his most recent interview on the subject on October 30, Kevin told Fox Business : 'It's a horrific accident and it's exactly that, nobody wanted this to happen and both drivers of both boats were given marine violations, they're not criminal charges'

Kevin returned to TV screens just 72 hours after the crash, with an appearance on CNBC’s Closing Bell, in which he did not disclose that it had happened.

In his most recent interview on the subject on October 30, Kevin told Fox Business: ‘It’s a horrific accident and it’s exactly that, nobody wanted this to happen and both drivers of both boats were given marine violations, they’re not criminal charges.

‘But out of respect for the families that were involved in this and the people that were injured, I really don’t discuss it much, because I want the process to just play out as it should.

‘I have a lot of respect for their privacy as they grieve. It’s horrible accident, just that, there’s nobody to blame, it’s sad that it occurred and my heart goes out to those families and that’s what I tell everybody.’

Kevin and Linda have been married for 29 years, although they were separated between 2011 and 2013.
