Kylie Jenner launches legal action against an Australian mother over a ‘rise and shine’ T-shirt

‘She has the cash to take us down’: Australian mother enters a David and Goliath legal battle with Kylie Jenner after the billionaire reality star issued her a ‘cease and desist’ letter over a T-shirt

  • Kylie Jenner has issued a ‘cease and desist’ letter to a Gold Coast woman
  • The woman has been selling tshirts with the phrase ‘rise and shine’ for a year
  • Billionaire Jenner is trying to trademark the phrase following a viral video

The world’s youngest billionaire Kylie Jenner has entered a legal battle with an Australian mother over a t-shirt she has been selling for more than a year.

The 22-year-old has issued a ‘cease and desist’ letter to a Gold Coast woman over the garment which features the words ‘rise and shine’.

Jenner is now trying to cash in on the phrase after a video of her singing a song with the words to her daughter Stormi went viral earlier this month.

The Gold Coast woman, who does not want to be named, said she was shocked to receive the letter after already selling hundreds of the shirts overt the last 12 months.

‘I used to really like her, now I’m like are you kidding me. The design wasn’t about her, it was just a shirt with a different holiday feel,’ she told The Gold Coast Bulletin.

‘We still have a few left but don’t plan on selling them now. I would be really p***ed if we had $4000 worth of T-shirts here but we only have about eight or so.’

The woman’s brand, Cased Clothing, has been operating since 2017 and is part of the family’s motorsport hobby.

‘They must have just done a blanket search on everyone who sells similar products. Unfortunately, we just don’t have the money to fight something like that and she has enough cash to take us down. It’s not worth it,’ she said.

Ms Jenner, 22, is the half-sister of Kim Kardashian and a regular on the family’s reality TV shows.

Her Kylie Cosmetics brand of makeup made her the world’s youngest billionaire aged 21 – being placed on the Forbes Magazine billionaires list in March 2019.

In 2017 she attempted to trademark the word ‘Kylie’ but was stopped by lawyers acting for pop singer Kylie Minougue.

In the United States Jenner has attempted to trademark the ‘rise and shine’ phrase but a challenge was issued this week by nutrition company Rise and Shine LLC.
