A married mother-of-three from Michigan had filed for divorce last year, and soon she began noticing that every time her now-estranged husband would make her morning coffee, she would feel tired, nauseated and bleary-eyed.

With her suspicions growing, Brian Kozlowski’s wife set up hidden cameras in their Macomb Township home, which in July 2018 captured her husband of 22 years repeatedly spiking her coffee with an antihistamine medication.      

On Thursday, a retired visiting judge sentenced the 46-year-old Kozlowski to 60 days in jail on weekends, followed by five years of probation. 

Ahead of the hearing, Macomb County Prosecutor Eric Smith released a statement expressing concerns that Judge Anthony Viviano would hand down a lenient sentence.

‘This defendant’s actions were despicable,’ Smith stated. ‘We are all thankful this sneak attack didn’t cause the victim to fall asleep behind the wheel on her way to work killing herself and/or innocent drivers.’

According to the prosecutor, in July 2018, Kozlowski’s estranged wife noticed that she felt tired, nauseated and was experiencing blurred vision soon after drinking coffee on the days that her husband prepared the beverage for her.

In May of the same year, the woman had filed for divorce from Kozlowski after 22 years of marriage. The couple have three children together, reported WXYZ. 

Kozlowski’s spouse became suspicious of his actions and installed hidden cameras in their kitchen, which caught her husband on multiple occasions spiking her morning Joe with an antihistamine drug called Diphenhydramine.

Diphenhydramine is the main component in the popular allergy medicine Benadryl.

After reviewing the videos, the woman contacted her divorce attorney and immediately moved out of the family house. She survived.

The last contaminated coffee that Kozlowski had brewed for the victim was analyzed and was found to contain 127 milliliters of Diphenhydramine.

A recommended dosage of the drug for adults is between 25-50mg.  

In December 2018, Judge Viviano told Kozlowski’s defense attorney said he would give the defendant probation, substantially below the sentencing guidelines calling for a minimum 19 to 38 months in prison.

In June, Kozlowski pleaded guilty to a felony count of poisoning. He could have faced up to 15 years in prison if convicted at trial.   

When given a chance to speak, Kozlowski’s ex-wife delivered an emotional impact statement, detailing how she almost fell asleep behind the wheel one morning after ingesting her husband’s tainted coffee.

She also recounted the first time she witnessed her husband mixing the drug into her coffee. 

‘I felt a horrible coldness in the air, as if I was hunted by a dangerous predator, but in this nightmare, the predator was Brian,’ she said. ‘I felt to my knees and cried.’ 

Kozlowski, dressed in a blue button-down shirt and tie, stood stone-faced at the defense table, only occasionally shutting his eyes as his wife described how on one occasion, their daughter accidentally ingested the poisoned coffee and nearly fell asleep at the wheel on her way to work.
