A man is suing his mother for $10 million after he suffered a serious brain injury at just nine months old when he was thrown from a car she was driving.

The woman lost control of the vehicle after swerving to avoid a kangaroo in outback Queensland in February 1999.

The now 20-year-old man, who was an infant at the time, was thrown from the car after it flipped and suffered multiple skull fractures and a severe traumatic brain injury.

Law firm Maurice Blackburn Rockhampton has made the claim on behalf of the man against his mother and her Compulsory Third Party insurer, AAI Limited.

‘He requires frequent prompting and supervision throughout the day to undertake even the most basic activities of daily living,’ Maurice Blackburn principal Meghan The Courier Mail.

She claims the man has been prevented from leading the normal life of a 20-year-old due to his injuries.

Ms Rothery said that although the claim is substantial it highlights the necessity of Queensland’s CTP insurance scheme.

‘The reality is that paid care is expensive and we are talking about decades’ worth here,’ Ms Rothery said.

The CTP scheme in Queensland requires children injured in motor vehicle accidents to lodge a claim before they turn 21.

Ms Rothery confirmed the insurer has already being paying for rehabilitation and medical needs for the man, however, a claim has not been lodged in court before so that the man’s ongoing care needs could be ascertained.
