A businessman who allegedly elbowed his girlfriend in the face knocking her unconscious has been allowed to walk free on bail after video was played to a court.

Marco Furia, 42, had spent three weeks in jail charged with two counts of assault occasioning actual bodily harm and was previously been refused bail at Sydney’s Waverly Magistrates Court on June 20.

But that changed when the NSW Supreme Court was shown CCTV footage from the apartment lobby in Bondi, where the alleged incident happened.

‘The footage totally contradicts the fact sheet,’ Mr Furia’s lawyer, Paul McGirr, told the court, the Daily Telegraph reported.

‘My client was never the aggressor and nowhere is it stated that Ms Veraldi repeatedly got physical with him, which is clearly visible.’

The CCTV shows Rossella Veraldi grabbing Mr Furia from behind several times trying to push and drag him outside the building through an open glass door.

She then appears to shove Furia against the lobby wall before Mr Furia allegedly turns and strikes her in the face with this right elbow.

Police allege she was knocked unconscious by the blow.

Ms Veraldi falls to the ground holding her head in her hands as Mr Furia walks away.

She eventually stands up and moves outside the glass door and lays on the ground outside the building.

A few seconds later, Mr Furia went out and hunkered down on a step in front of the apartment block.

Ms Veraldi was later seen outside the building wearing only jeans and a bra, and police were called to the scene where they arrested Mr Furia.

Mr McGirr told the court his business nearly collapsed while he was in jail and that ‘if not for the CCTV footage would most likely still be there’.

Mr Furia will face court again on September 26.
