Paris Hilton’s parents are demanding the lawsuit brought by their former housekeeper be dismissed and are now accusing the woman of stealing from their home, DailyMail.com can reveal.

Kathy and Rick Hilton, who are worth a reported $300million, filed their answer to the lawsuit brought by their former housekeeper Isabel Reina Gonzalez Hernandez last summer.

They deny Hernandez’s allegations that they failed to provide her required meal breaks or pay her overtime wages.

According to court documents obtained by DailyMail.com, the couple say that if the court finds they owe their former employee anything, it should be offset by ‘plaintiff’s theft of items from defendants’ home.’

Last summer, Hernandez filed a lawsuit accusing her employers of failing to pay required overtime, not providing her with required meal and rest periods, and unfair business practices.

She was hired to be a live-in housekeeper and was to be paid a weekly salary. Hernandez claims she worked overtime hours but was failed to be paid for it.

According to the Labor Code, live-in employees cannot work more than 12 hours consecutively in a 24 hour period and are required breaks.

But Hernandez said she worked for the Hiltons more than 12 consecutive hours, without being allowed the three hours of off-duty time.

At times, she claims, she worked more than 10 hours during each work period without being provided with a second meal break.

Hernandez, who worked for the family for at least four years, also claims she worked more than five days per week without a day off.

On the sixth and seventh days that Hernandez claims she worked, she said she was never paid the required overtime pay.

The suit states that the Hiltons ‘knowingly and intentionally’ failed to provide Hernandez with accurate pay statements.

Kathy and Rick Hilton deny all of Hernandez’s claims, saying that she has been paid all income, compensation, wages and salary ‘to which she has ever been entitled.’

They are asking for the lawsuit to be dismissed.

According to court documents filed in Los Angeles, the couple ‘are entitled to a complete and/or partial offset against each and every cause of action alleged in the Complaint.’

They couple believe the amount should be established at trial ‘based in part or in whole’ on alleged theft from their home.

Kathy and Rick claim the suit should be barred by the ‘doctrine of unclean hands’ which means they believe Hernandez had no grounds to file against them because she is acting unethically or has acted in bad faith.
