Photo agency agrees to drop suit against Khloe Kardashian

A photo agency that sued Khloe Kardashian for more than $175,000 after she shared a photo of herself to Instagram has dismissed its case, DailyMail.com can reveal.

Xposure Photos and Khloe Kardashian on Tuesday agreed to dismiss the lawsuit, which was filed last year and saw the UK-based photo agency sue the Keeping Up with Kardashians star over one of its pictures of her and her sister, Kourtney.

They agreed to dismiss the California lawsuit ‘in its entirety’ and both parties would ‘bear their own fees and costs’, according to court filings exclusively obtained by DailyMail.com.

In a now-deleted Instagram post from September 14, 2016, Khloe had shared a photo of herself and her sister, Kourtney, heading into a Miami restaurant.

The paparazzi photo belonged to Xposure and was solely licensed to The Daily Mail at the time of the posting.   

Xposure said Khloe, who never licensed the photo, made the image ‘immediately available to her nearly 67 million followers and others, consumers of entertainment news – and especially news and images of Kardashian herself’, the lawsuit said. 

The agency sought $150,000 in damages for ‘willful, intentional, and malicious’ copyright infringement.

It also demanded sued for damages of $25,000 for the ‘unauthorized alteration or removal of copyright information’.

‘Plaintiff never licensed the Photograph to defendants,’ stated the complaint, which cited Khloe and ten anonymous Jane Does as defendants, according to the Hollywood Reporter.

The complaint continued: ‘Nevertheless, defendants have used, and continue to use, the Photograph without authorization or permission from plaintiff to do so.

‘Specifically, Kardashian copied the Photograph and distributed it on Instagram on September 14, 2016.

‘The copy of the Photograph that Kardashian distributed on Instagram had been altered to remove the CMI [copyright management information] showing plaintiff as the copyright owner of the image.’ 

Meanwhile, Khloe 31 weeks pregnant and and due in just a matter of weeks.

The girlfriend of NBA player Tristan Thompson, 33, is expected to give birth in late April.
