Russian woman raped by her anaesthetist after breast surgery

A fashion designer was raped by an anaesthetist as she came round from plastic surgery on her breasts, Russian police say.

Dr Yury Chernikov, 59, faces up to six years in jail if convicted on charges of rape and sexual violence in a trial in Samara.

Alleged victim Erika Bykova, 35, has waived her anonymity to claim she felt ‘helpless’ under the influence of anaesthetic – and unable to scream or stop the ‘attack’.

Chernikov, a grandfather, admits to having sex with married Bykova minutes after her surgery but claimed it was consensual, and alleged in a statement to police that the patient had told him she was ‘feeling good’.

The mother-of-one – who had the surgery to ‘improve the shape’ of her breasts – told a TV audience: ‘I was moaning. But I was moaning because I couldn’t scream.’

She said: ‘It was the very first surgery in my life. I saw him before the surgery. He came to my ward to talk about the results of my pre-operation checks.

‘My husband was against the surgery – he believed that I was beautiful enough already. I was shaking crazily after the operation, and I heard a voice telling me: ‘Girl, everything will be okay, everything will be fine’.

‘He was touching me, it was the anaesthetist’s voice. Then he allowed himself to do things that a doctor must not do. He was commenting on what he was doing.

‘He raped me. I was in a helpless state. At that moment I could understand everything but my eyelids were very heavy, I even couldn’t open them fully.

‘I tried to push him away with my legs but I couldn’t do that.’

She was unable to scream for help, and they were alone in an ante-room to the operating theatre, she said.

‘I absolutely trusted the doctor. I trusted him with my life and body. For a long time I couldn’t pull myself together and talk to my husband about it.

‘I even filed a complaint to the Investigative Committee (in charge of probing serious crimes) and asked detectives not to interrogate my husband – at least for some time.

‘I had gone to the police station and filed the complaint to the Interior Ministry in (Samara) the very day when I was released from the clinic.’

She alleged: ‘He offered me money – he didn’t specify how much – to take back my complaint.’

She said: ‘I am sorry for sharing these details (but) I am speaking out to help women in the same situation who cannot talk about it to anyone.’

Her long term aim was to ‘create a community where women could share what happened and protect themselves’.

Dr Chenikov admitted to Russian state-funded channel NTV: ‘Yes, there was sexual intercourse. 

‘I constantly controlled my actions, all the touching and licking. I was asking her: “Erika, are you feeling good, am I not hurting you?”

‘And she answered: “Yes, I’m feeling good”.’

He said that he performed a sex act on her and ‘she kept her legs spread – she didn’t try to say a word or stop it’.

The doctor admitted: ‘Obviously, five minutes after everything happened, I was terrified. And I realised my children, my grandchildren, my wife would never forgive me.

‘At that moment I hadn’t been thinking about anything. Another organ was doing the thinking.’

In his latest testimony to detectives ahead of the court case, he claimed that after the sex was over the woman told him she ‘hadn’t felt so good in a while’.

He went home to his wife in the evening after having had sex with his patient – but then had a call to say Bykova’s friend was asking him to return to the Plastic Surgery Centre, the clinic where the alleged rape took place.

He went back and the friend told him Bykova could be pregnant ‘but didn’t express any complaints about what happened’.

He went to see the patient bringing her chocolates and ’emergency contraception pills’. They had a ‘lovely chat’, he alleged.

Later, he said, she asked him to provide her with a medical report proving he did not have sexually transmitted diseases. He did this, he said.

But at their next meeting, she told him she was reporting him for rape, he said.

He told investigators he confessed what had happened to his wife of 35 years called Tatiana, and then apologised to Bykova.

‘I was humiliating myself, begging her forgiveness although both of us knew what we had was voluntarily – and she wasn’t in a helpless state,’ he alleged.

‘She asked me several times to settle a compensation payment for sleeping with her.

‘But I had no time to do that, and I didn’t know how much one would pay for it.

‘In the course of interrogation (with detectives) I initially admitted my guilt because I was afraid that if I hadn’t done so, I would be arrested and put in jail.

‘That was what I was afraid of. Now, I do not fully admit my guilt – because I believe there was no rape.

‘During sexual intercourse (the patient) was not in a helpless state. She was able to fight back and could have expressed her protest.

‘I didn’t force her physically or psychologically to have sex. I believe (rape) is a false denunciation.’

His lawyer Vadim Safronov said: ‘She was saying that she couldn’t move but the medication does not have such an effect.’

She said: ‘My husband was the first person who told me what happened…. He has hypertension and perhaps it was caused by stress.

‘We’ve been living together for 35 years -I know him better than anyone else. Yes, he could have been weak as a man but he would not hurt anyone. There have been no such situations before.

‘He asked me to forgive him and I did because I love him a lot. He apologised to her, he honestly told me that he apologised for what happened.’

Dr Chernigov is accused of rape and violent sexual actions.

Both can we punished by up to six years jail under Russian law. Any sentences would run concurrently.

Bykova’s unnamed husband – the father of her five-year-old son – has not commented on the case.
