Who are Trump’s 30 unindicted co-conspirators? Bernie Kerik, Boris Epshteyn, and surfer from Hawaii are among individuals who were referenced but NOT charged as part of alleged ‘criminal organization’

The grand jury indictment that Fulton County DA Fani Willis announced Tuesday included reference to 30 unindicted conspirators who took part in many of the events alleged, but managed to avoid charges.

The defendants, including former President Donald Trump and 18 others – plus ‘unindicted co-conspirators Individual l throughIndividual 30’ – ‘constituted a criminal organization,’ according to the indictment, which charges the 19 with conspiring to overturn the election results in Georgia.

Among them are people in Trump’s orbit and who were advising him on Election Night 2020, when he said ‘frankly, we did win this election.’  

 

Boris Epshteyn

Epshteyn, a lawyer who continues to advise Trump, as been identified as Individual 3, CNN reported. 

He appears in the indictment as the recipient of an email from indicted Trump lawyer John Eastman, who is accused of joining Trump on a call pushing Vice President Mike Pence to refuse to accept electoral votes certified by states. 

‘Better to act boldly and to just be challenged,’ Eastman wrote him, in an email uncovered by the House January 6 Committee that appears to ID him as the unindicted co-conspirator. 

The longtime Trump aide was reportedly interviewed by Special Counsel Jack Smith’s investigators. He was arrested in 2021 for groping two women at an Arizona nightclub.

Bernard Kerik

Former New York City Police Commissioner Bernard Kerik has been identified as unindicted co-conspirator 5. 

His lawyer, Tim Parlatore, who previously represented Trump, confirmed that Kerik appears to be the person mentioned – but blasted the DA for including him as part of a conspiracy.

‘What they are alleging there was a legislative hearing that he watched. There was a meeting that he was at. There’s an email that he was cc’d on. That’s it. That is not a coconspirator,’ he told DailyMail.com.

Kerik is a longtime associate of former New York Mayor Rudy Giuliani, who was the second person named in the criminal indictment. He was once a top official at Giuliani partners.

He spoke to investigators for Special Counsel Jack Smith, Parlatore said. But he never testified in Fulton County because Willis ‘never asked.’

The indictment refers to the official attending meetings with state legislators where Trump and his allies were pushing audits and seeking to overturn the results.

Trump pardoned Kerik in 2020. A decade earlier, Kerik was sentenced to four years in prison on charges related to failure to pay tax and lying to government officials during during a political nomination vetting.

Fitton, the president of Judicial Watch, has been identified as unindicted co-conspirator 1. He penned an Oct. 31, 2020 memo with draft language for Trump to declare victory before Election Day, and calling it ‘lawless’ to count votes that arrive after Election Day. ‘The voters have spoken,’ he urged Trump to say.

Phil Waldron

A House January 6 Committee report describes a Nov. 25, 2020 White House meeting that appears to out Waldron’s identity as unindicted coconspirator 6.

The retired Army colonel and bar owner was subpoenaed by the Committee.

In the days after the elections, he promoted a variety of conspiracies about the vote count, working with Giuliani and others.

Individual 6 is identified as attending a meeting with Arizona legislators in Phoenix along with Giuliani and Trump lawyer Jenna Ellis.

 

Georgia Lt. Gov. Burt Jones

The indictment also appears to reference a tweet by the sitting Georgia Lt. Governor, Burt Jones.

A Georgia state agency said a special prosecutor will be named to probe Jones, after a judge called out Willis for probing him having donated to his Democratic opponent. 

Jones was one of 16 Republican electors who served as ‘fake’ electors, in a central element of the prosecution’s case. The former state senator also pushed a special session that could have helped overturn Joe Biden’s win in Georgia.

Meanwhile, the Washington Post identified several people who appear to be involved in the effort to extract voting information from Coffee County, Georgia voting machines, a key episode outlined in the indictment. 

It cites a Georgia lawsuit to determine that Alex Cruce was ‘Individual 24’ who flew from outside Atlanta to an airport there ‘for the purpose of assisting with the unlawful breach of election equipment,’ according to the indictment.  

The Post identified former pro surfer Conan Hayes, 48, as receiving an email from the COO of data forensics firm SullivanStrickler saying he would get data from the voting machines.

 Information about an email that lawyer Ken Chesebro sent to Georgia officials, combined with January 6 evidence, appears to point to state party officials including former first vice chair Carolyn Fisher party treasurer official Vikki Consiglio.
