Oregon man opens fire on neighbors with an AK-47 and injures both

An Oregon man is accused of attempted murder for allegedly shooting two of his neighbors because he was tired of the noise one of their children made. 

Franklin L. Tomes, 59, was said to have shot 12 rounds from an AK-47 when he fired at Jose Gaeta and Tristan Smith – both 20 – in Newport, Oregon, around 9.15pm. 

Gaeta was shot twice in his legs and once in his foot while Smith was shot in his shoulder, Oregon Live reports.

Seven rounds flew into Smith’s apartment while his mother and her boyfriend were inside the home. 

About six of those 7.62 caliber bullets hit a back wall on the other side of an apartment.

The court affidavit details that Tomes lives in the apartment unit below Gaeta which is not too far from where Smith lives as well. 

He had been upset with the noise that Gaeta’s kids were making and had gotten into an argument with the man.

He then grabbed his gun and opened fire on the two victims, choosing to do so again once they tried to flee indoors

Tomes was then said to have grabbed the rifle from his car and loaded it before opening fire on the two men, the affidavit said.

Putting the gun away, Tomes brought it back out to continue firing at the men when they tried to run away. 

The man went back into his apartment after the shooting and stayed there for five hours before police detained him.

Inside his apartment was the weapon. 

Tomes was charged with two counts of first-degree assault, two counts of pointing a firearm at another, unlawful use of a weapon, four counts of reckless endangering and two counts of attempted murder, KOIN reports. 

He was booked in the Lincoln County Jail, KPTV said. 

The two victims were taken to a nearby hospital for treatment and both have since been moved to a hospital in nearby Corvallis.
