Elderly man acquitted over cyclist’s death in WA

An elderly man who admitted to killing a cyclist with his car in Western Australia, but claimed he did not remember the incident because of a medical condition, has been acquitted.

Keith Michael Osman was driving to a library on Old Coast Road in Mandurah on March 29, 2016 when he hit 70-year-old Gabriele Schiller-Brett and dragged her and the bike under his car.

Mr Osman had been on trial in the WA District Court charged with dangerous driving occasioning death, failing to stop and render assistance, and failing to report the crash to police, but was found not guilty of all charges by a jury on Thursday.

Ms Brett was left with injuries to her chest, legs, abdomen and pelvis, and died in hospital soon after the crash.

Prosecutors accused Mr Osman of not helping the woman after hitting her or reporting the incident to police. 

Mr Osman’s lawyer, Sam Vandongen, argued his client was in an ‘automatic state’ caused by a hypoglycemic attack – caused by his type two diabetes.

Mr Vandongen told the court an episode such as this can ‘result in an automatic state where the mind is not connected to the body… and affect memory’.
