Max Kennedy was sober during arrest says brother RFK Jr.

Robert F. Kennedy Jr. is defending his brother Max from claims he may have been inebriated when he was arrested at a house party near the family’s Hyannis Port estate in the early hours of Sunday.

‘I can tell you that Max Kennedy was sober as a judge,’ Robert Jr told the Cape Cod Times. 

‘He hasn’t had a drink or a drug for 35 years.’

Meanwhile, a female guest at the party who asked to not be identified provided a video to the paper showing 12 people singing ‘Piano Man’ at 1:19am, just before police broke up the ‘rowdy’ party. 

That is when Max reportedly screamed, threw himself at the wall, and smashed a cabinet according to a police report obtained by DailyMail.com.

The son of late senator Robert F Kennedy was joined by his daughter at the police station soon after when she ran after her father.

‘From what I saw, she was just trying to make sure he was all right,’ said family friend Robert Nixon. 

‘She was really upset about him. What is being reported is very far from the truth.’

Just a few days prior, Max had been photographed out sailing with Dennis Kucinich.

According to Barnstable Police Officer Armando Feliciano, who arrived at the scene just after 1am, the father-daughter duo ‘incited…an angry mob’ among members of the party. 

Caroline, 23, reportedly refused to give police her information and admitted to being drunk while she was booked.

Her father, 52, was described to be ‘sweating profusely’ and had ‘noticeably’ blood-shot eyes. 

They were charged with disturbing the peace and violating a noise ordinance. Both of the Kennedys were bailed out that same night.

Details of their arrests emerged a day after the father-daughter duo’s mugshots were revealed.

Police busted the loud party on Sunday at 172 Irving Avenue, in Hyannis Port, Massachusetts, after receiving multiple calls complaining about a ‘loud party and fireworks.’ 

In his report, Feliciano described seeing people ‘drinking and singing music on a microphone,’ once he arrived at the scene. 

The officer made his way to the front door of the home where he asked a woman if he could speak to the person in charge of the party. 

According to Feliciano, a sweaty and ‘glass-eyed’ Max Kennedy then came to the door and ‘immediately became angry’ with the officer.

‘He appeared to be very unsteady on his feet and his movements were erratic,’ – and had been ‘sweating profusely’ the police report stated.

After he asked Kennedy for identification, the 52-year-old began to scream at the officer to not enter the home. 

Party guests allegedly turned the music back up while Feliciano attempted to bring the disturbance under control.

He writes that at that time, ‘I had made several efforts with several different guests to end all the noise disturbance to no avail,’ so Feliciano proceeded to enter the home. 

However, Max Kennedy reportedly responded by ‘screaming incoherently and throwing himself at the wall.’ 

‘When he hit the wall, he grabbed a wall cabinet (filled with glass valuables) and threw it smashing its contents.’ 

After a brief struggle, the officer put Kennedy in handcuffs in front of members of the party who began to yell ‘you don’t know who you’re messing with.’ 

Max Kennedy (who was born Matthew Maxwell Taylor Kennedy)the son of Senator Robert F Kennedy and Ethel Kennedy, is a writer and previously worked as a district attorney in Philadelphia.

Kennedy’s arrest, sparked outrage among the party guests who went outside and into the middle of the road as he was put in custody. Feliciano then requested additional back up.

He said a woman, who was later identified to be Kennedy’s daughter Caroline Summer Rose, approached his cruiser and opened the door –  which flared up the crowd even more.

Caroline was handcuffed and placed into a separate cruiser.

No-one else was arrested at the party.

According to reports, the 23-year-old refused to cooperate with police during her booking and admitted she was drunk.

She told officers, ‘I went to Brown and I’m a teacher, sweetheart!’ before sticking out her tongue and bursting into tears.

Max Kennedy, who was also believed to be drunk, was given a breath test, but no alcohol was detected.  

Barnstable Police Lt John Murphy told the Boston Herald that the law was punishable by a $100 fine and arrest.

If found guilty, they will not face jail time, as neither of them has a criminal record, police said.

Both Kennedys were released on their own recognizance the night they were arrested, and Max was arraigned in Barnstable District Court on Monday.

His pretrial hearing on the disorderly conduct charge is set for November 22.

Caroline Kennedy’s arraignment has been set for the same date. It’s unclear why she was not arraigned around the same time as her father.

The property does not belong to the Kennedys – although Max lives elsewhere in Hyannis Port.

It is a nine-bedroom rental home known as the ‘Judy Garland House’ after the actress, who used to spend her summers there. 

Max is probably best known for the book he wrote about his grandfather, ‘Make Gentle the Life of This: The Vision of Robert F Kennedy.’

He is one of nine children born to Robert and Ethel Kennedy.

His arrest, and that of his daughter, comes eight months after his nephew – Conor Kennedy, son of RFK Jr – was arrested.

Conor Kennedy, an ex-boyfriend of Taylor Swift, was charged with disorderly conduct after he punched a man outside a nightclub on December 29 in Aspen. 

However, he avoided going to court after agreeing to a plea deal that saw him given a six-month deferred sentence.

The Kennedy compound was purchased by Joseph P. Kennedy Sr, father of RFK and John F Kennedy, in 1928. It was expanded upon, but the original structure was built in 1904.
