A pervert oncologist has avoided jail time after indecently assaulting the daughter of a cancer patient during an impromptu breast examination, despite being previously jailed for sexually abusing a trainee doctor.
John Kearsley, from Sydney, was sentenced to 340 hours community service on Monday over the 2012 assault in which he squeezed the nipples of the 49-year-old woman.
The 64-year-old former senior oncologist at St George hospital is on parole after serving a jail term for spiking a young doctor’s drink and sexually assaulting her at his home in 2013.
The victim in the latest case said outside Sutherland Local Court on Monday she is at ‘a total and complete loss’ as to how he avoided another prison sentence.
‘I definitely do understand why victims are so reluctant to take on people of the higher echelon. It seems to me like they’re very well protected,’ she said.

‘Right now I’m not feeling very courageous or victorious or anything – I guess I’m a little flat.
‘But the fact that he isn’t accountable and detained behind bars and hasn’t had his liberty deprived seems to me a little bit light on,’ she added, according to the ABC.
Kearsley invited the woman into his office in December 2012, saying he wanted to talk about her father’s prostate cancer.
He offered her sandwiches and champagne before he said: ‘Your mother died of breast cancer didn’t she?’ – The Daily Telegraph reported.

He then offered to perform a breast examination before indecently assaulting the woman.
Because the 2012 offence pre-dated the later sexual assault, magistrate Michael Connell considered Kearsley to be of prior good character.
The judge noted the need for general deterrence and Kearsley’s serious breach of the woman’s trust when she was in a vulnerable position.
But he also took into consideration Kearsley’s remorse and rehabilitation.
A psychiatrist reported a significant improvement in his mental health since he began twice-weekly sessions several years ago.
‘Right now I’m not feeling very courageous or victorious or anything – I guess I’m a little flat,’ the victim said
