The Real Housewives of Beverly Hills star Erika ‘Jayne’ Girardi scored a major win Monday in the $5M fraud lawsuit filed by two ex-colleagues – Philip R. Sheldon and Robert P. Finn – of her estranged second husband Thomas Girardi.

Erika’s attorney Evan C. Borges told Page Six on Wednesday that LA Judge Richard Fruin ruled there was no evidence the 51-year-old reality star had ‘actual knowledge’ of ‘wrongdoing’ by the 83-year-old disbarred lawyer.

Therefore, Jayne (born Chahoy) could not ‘aid and abet’ him in allegedly embezzling the $2M settlement meant for the families of the victims of the fatal 2018 Lion Air plane crash.

‘Listen, they did all the book at Girardi & Keese. They were in charge of all the ledgers…I didn’t do the invoices,’ the Atlanta-born socialite said in her deposition.

‘I just thought it would all be taken care of. I didn’t really ask. Like, it’s not like I was raking in millions of bucks…I didn’t know what they were doing down there.’

The judge ruled that the evidence of Erika’s ‘lavish and extravagant’ lifestyle ‘funded by the spouses’ community property is not evidence of the “actual knowledge” any breach of fiduciary duty’ as attorneys ‘do not owe fiduciary duties to their co-counsel.’
