Kevin Spacey ‘victim’ shoved him against wall after star ‘grabbed his crotch’, court hears

A man told a court he pushed double Oscar winner Kevin Spacey against a wall at his luxury Cotswolds holiday home after the actor ‘aggressively’ grabbed his crotch.

The 63-year-old double Oscar winning actor is accused of assaulting four men ‘for his own sexual gratification’ between 2001 and 2013.

Jurors have heard the star is a ‘sexual bully’ who delighted in making his assault victims feel ‘powerless and uncomfortable’.

Spacey carried out offences involving grabbing, squeezing, and touching of his four victims’ genitals and buttocks over their clothing, Southwark Crown Court has heard.

He carried out the alleged assaults mostly during his time as Artistic Director at The Old Vic theatre.

The second alleged victim has described how the American Beauty star assaulted him at his holiday home in an exclusive private housing estate in the Cotswolds.

After necking a double Jack Daniels on the rocks, Spacey allegedly kissed the man down the neck twice and grabbed his crotch while telling him ‘Be cool. Be cool’.

Giving evidence to jurors over a video-link on the fourth day of the trial the man said the alleged assault at Spacey’s hands was ‘shocking and very surprising’.

He said when he opened doors at the Cotswolds house the actor’s little dog ‘shot out’ so he retrieved it.

‘I just remember turning round after I put the dog back in whichever room it was that it had come out of.

‘When the incident occurred, I was quite shocked and I just wanted to leave the property.’

He said Spacey gave him a hug.

‘I sort of did an awkward few pats on the back. I wasn’t as comfortable in the hug as he was.

‘I didn’t want to be offensive, we were in his home.

‘At which point he moved his head towards my neck and kissed it twice moving upwards and said “be cool, be cool” between the kisses and then grabbed my crotch.’

The man admitted he was usually only a ‘huggy’ person with people he knew well.

He added: ‘It was more than a peck, but not a French kiss or anything like that. It was longer than a peck would be.

‘Momentarily [I froze] then when I felt the hand on my crotch I immediately took the hand I had patted him with and used a motion like that (gestures blocking with arms).

‘It wasn’t fast or anything, it was slow and purposeful, it wasn’t with force.

‘I immediately put my hand between us two and pushed him against the wall. I would have still had my elbows folded.

‘His eyes opened wide, then he immediately put his head down.

‘I stood there momentarily. I shook my head in disbelief and immediately decided to leave the property.’

Asked about Spacey’s demeanour he said: ‘I wouldn’t say embarrassed. He seemed more shocked that he had been called on his actions so abruptly, maybe.

‘It made me immediately defensive. I wouldn’t normally be an aggressive person but that was definitely out of my comfort zone.

‘It was quite sobering when it happened and I immediately wanted to leave the situation. I felt immediately uncomfortable and shocked.’

The man later called his father who came to get him.

‘I became teary when my dad got there. I got a bit emotional. I got in the car and I felt safe I guess and then it all sort of flooded a bit.’

Asked if he at any point in the evening gave the impression he was interested in Spacey, he said ‘not in the slightest’.

He denied that he ever considered pursuing a civil claim against Spacey. Jurors were shown an email that the man sent to info@kevinspacey.com where he requested to reach a ‘settlement’.

Mr Patrick Gibbs, KC, defending Spacey, asked what kind of settlement he had in mind.

The man replied: ‘Resolution. I had more important things occurring in my life in October 2022 than this.

‘You work for money.

‘The reason I reported [the assault] in November was, I didn’t want it to be this far, this involved.

‘I just wanted it to be a character statement to help somebody else.

‘As far as I was concerned, I was a grown man and someone did something to me and I pushed them off. Just happened to be a celebrity.

‘It was an aggressive come-on.

‘[Spacey came-on] in a very aggressive manner.’

He was then asked by the barrister about the ‘small light coloured’ dog he let out of the house.

Mr Gibbs told jurors that at the time Spacey only had a black dog and asked the man if he may have ‘misremembered’ the layout of the Cotswolds house.

He replied: ‘Entering the property wasn’t hugely memorable. It was just to have a drink and continue chatting to people.

‘A number of the people who were there went on a tour of the house, myself and my friend didn’t have an interest in that so got a bottle of wine and went outside for a drink (…) and had a cigarette.’

Earlier he recalled meeting Spacey and his crowd at a pub, before they went to his house.

He said: ‘He [Spacey] was sitting down with quite a few people around him.

‘It was busier than a normal Sunday. He seemed to be talking to a group of people. It’s not exactly the type of pub you’d expect to find that clientele to be in.’

He said while drinking at the pub with Spacey he had six pints of Guinness.

He said: ‘Spacey was drinking a similar amount of Jack Daniels and Coke. We did shots of tequila with Mr Spacey.

‘When we did shots [of Jägermeister] five or six of us did that and he did that too. It was an enjoyable evening.

‘We all got to know each other telling stories and stuff as the night went on, as you do when you’re socialising.’

Summarising the evening, the man said: ‘I wouldn’t describe it as extraordinary or wonderful. Just a night in the pub.

‘Just a night in the pub and then we continued an enjoyable night back at the house a bit longer.’

The man admitted it was ‘very much’ an unexpected evening and said he found Spacey ‘camper’ in real life, compared to his screen presence.

Spacey’s entourage in the pub referred to Spacey as ‘K-Dog’, he said:

‘It was an endearing aspect of it as we became more familiar with each other. He found it amusing.’

He said spliffs of cannabis were readily available at the Cotswolds house.

The man told jurors: ‘There were spliffs on the table, dotted around the table in the living room and the island in the kitchen.

‘I rerolled one of the ones he had lying around and smoked it on the veranda.’

The man would then share the spliff back and forth with Spacey, each taking drags from it.

Spacey, originally from New Jersey, USA, denies three counts of indecent assault, seven counts of sexual assault, one count of causing a person to engage in sexual activity without consent, and one allegation of causing a person to engage in penetrative sexual activity without consent.

The two-time Oscar winner starred in Glengarry Glen Ross, Seven, LA Confidential and Baby Driver. He also had the lead role in the Netflix series House of Cards.

The four-week trial continues.
