Wolverhampton A&E doctor struck off after sexual assault

A predatory A&E doctor who claimed he had a mobile phone in his pocket when two female colleagues accused him of having an erection has been struck off.

Dr Mohammed Yasin, 30, was sexually aroused when he approached the student nurse and healthcare assistant on a hospital ward then hugged them tightly. 

He also moved his hands down their bodies and thrust against them and pressing his upper legs into the two women who claimed the doctor was ‘pleased’ to see them.

But at a medical tribunal Yasin – who was working as a locum at the New Cross Hospital in Wolverhampton in the West Midlands – denied sexual misconduct claiming the women may have been confused as he had a Nokia Candybar handset and car key fob which were always in his trouser pocket.

He also said he hugged the women – known as Miss A and Miss B – because he wanted to ‘fit in’ and had seen other colleagues of a similar background to himself doing the same.

At the Medical Practitioners Tribunal Service in Manchester, a disciplinary panel accepted Yasin ‘may well have had such items in his pocket’ at the time of the incident in April last year but found him guilty of sexually motivated conduct.

Panel chairman Richard Tutt said: ‘Dr Yasin abused the special position of trust a doctor occupies and demonstrated sexually motivated predatory behaviour towards two junior female colleagues in the workplace, who were vulnerable by virtue of Dr Yasin’s respective seniority.

‘Having sexually assaulted Miss B, within a period of approximately two hours, Dr Yasin persisted in his sexually motivated predatory behaviour when he then sexually assaulted Miss A.

‘His behaviour towards Miss A, the more vulnerable of the two complainants, was particularly persistent as he continued in his actions twice after she had moved away from him. 

‘Subsequently, Dr Yasin has shown limited insight into the less serious allegations made against him, and has shown little or no insight in relation to the more serious aspects of his behaviour.’

Miss A was a student nurse at the time, undertaking her degree course and wanted a job in the Accident and Emergency Department.

The 21-year-old was picking up as many shifts as she could in an attempt to impress her bosses to clinch a job. 

As a result, she kept her mouth shut because she did not want to kick up a fuss and cause trouble.   

Mr Tutt: ‘The Tribunal accepted that as far as Miss A was concerned she might have a great deal to lose by making a complaint against Dr Yasin.

‘In relation to Miss B, Dr Yasin hugged her and rubbed himself against her legs and then thrust his legs against her legs. 

‘He pushed his erect penis on to her leg and moved it back and forth then moved his arms from Miss B’s back towards her hips.

‘The “hug” having finished Dr Yasin said words to the effect of “I want another hug before the end of my shift”.

The tribunal heard how the doctor stood behind Miss A and moved his hands from her shoulders down her body to her waist and back again.

Miss A left the immediate vicinity and upon her return some minutes later, Dr Yasin hugged her front to front, pressing his erect penis against her lower abdomen. 

She managed to break free and stood closer to Nurse Nyawo, but the doctor moved to stand by her again and hugged her from behind, wrapping his arms around her shoulders, pressing his erect penis into her back.

‘Dr Yasin abused his position as a doctor, preying on junior colleagues,’ said Mr Tutt.  

During the hearing Yasin was described as ‘cringey and horrible’ by one of the women. 

Miss B, who as assaulted as she was assisting an elderly patient to the toilet said: ‘It’s not something that happens every time you go to work. 

‘His erection was coming on as he was hugging me. As we hugged I could feel him pushing on my leg as he was grinding up and down.

‘I knew it was an erection because I didn’t feel it straight away. I know it wasn’t a marker pen or anything like that because I would have felt it straight away. 

‘I said I could feel it when he started hugging me, it was not there in the first few seconds but it was there afterwards.

‘If it was a marker pen or a banana I would have felt it straight away. I know the difference between a mobile phone and an erection. 

‘It couldn’t have been a mobile phone or a set of keys. As we carried on hugging it started to grow. 

‘It’s embarrassing because I gave the hug back and this happened.’

Miss A said: ‘I do remember he had an erection, it was visible. I just noticed it. I don’t think it was a phone or a key fob. 

‘But I felt reluctant to make a complaint, it’s a big thing to come forward and it may have consequences.

‘I wanted a job there and didn’t want any issues that would affect that. But the whole thing made me feel uncomfortable from start to finish. 

‘He did have a visible erection and did move his hands down to my waist and back.

‘I don’t see doctors hugging nurses as often as nurses hugging nurses. In terms of me and Dr Yasin there had never been any physical contact.’

But Yasin, from Birmingham told the hearing: ‘I was not aroused – I can only imagine I had something in my pocket st the time. 

‘I would have carried my Nokia phone, key fob and tissues.

‘They were mistaken about me having an erection. When the complaint was made I was upset and shocked. 

‘I was offended and hurt by the fact they said I had an erection. The only explanation I’ve got is my phone and key fob – I don’t know how they perceived the erection. 

‘I don’t even find these girls attractive.

‘Hugging was something that was not normal for me in terms of my upbringing. 

‘I saw that people were hugging people of a similar background to me so it would be ok. 

‘I felt hugging was just part of the culture at work, it was not something I was used to when I was brought up.

‘Within my culture and background there’s respect for women and respect for women physically. 

‘For males and females to touch each other if they are not married us considered both inappropriate and wrong.’
