Victorian man jailed for raping unconscious ex-girlfriend

A Victorian man who knocked out the mother of his young daughter when he kicked her down stairs and later raped her three times has been sentenced to almost 11 years’ jail.

In the County Court on Friday the man, who cannot be named for legal reasons, was jailed on two counts of intentionally causing injury, assault, and three counts of rape ‘against the mother of the child you claim to adore’.

The man denied the charges but was found guilty by a jury trial in May.

In 2012, the couple attended a New Year’s Eve party, with the man becoming angry his girlfriend had spoken to another man, the court was told.

He punched and kicked the woman, who was drunk, before kicking her and causing her to fall down the stairs.

The next day, he told her she’d fallen down the stairs drunk.

In July 2013 after the pair separated, the woman invited him over for a drink as their two-year-old daughter slept in another room.

The man raped her after she refused to have sex with him, the court was told.

She managed to escape to the bathroom, but he followed her and put his arm around her neck, causing her to lose consciousness.

She woke on the bathroom floor to find she was again being raped.

A third rape followed.

The man then ‘accompanied’ his ex-partner as she comforted their crying daughter.

In a statement to the court the woman said she was scared for her life and suffered post traumatic stress disorder as well as ongoing head and neck problems.

She found giving evidence at the trial ‘humiliating and painful’.

‘She was obliged to relive in front of strangers the traumatic experiences you subjected her to,’ the sentencing judge said.

The judge said the man, who had been diagnosed with an ‘unstable personality disorder’ had used his physical strength to overpower the woman.

‘(It was) a serious assault on a small woman who should have been able to trust you,’ the judge said.
