Kmart is dealt brutal blow in bitter legal fight with customer over $625,000 payout after she was injured at one of its stores

A Kmart customer has won a huge compensation payout against the shopping giant after a mountain bike fell on top of her inside a store.

Rita Marmara, 64, was injured at the self-checkouts of the Kmart store in Woy Woy, on the NSW Central Coast, in September 2018 when a large box containing a mountain bike fell on her from behind.

The grandmother, from Sydney, took Kmart to the NSW District Court where she claimed damages of $743,971 to cover medical bills and lost earnings.

She told the court that she had two operations after the incident and that her neck and shoulder pain had left her unable to continue work at a retirement home.

On Tuesday, the NSW Supreme Court dismissed Kmart’s appeal and ordered the store to pay Ms Marmara $624,775.60 plus costs.
