City trader ‘raped a drunk university student’ in Brighton

A City trader allegedly raped a drunk university student at her halls of residence after helping her home from a jazz club. 

Livio Dinaj, 24, is accused of attacking the young woman within hours of meeting her during a night out at Casablanca’s in Brighton, East Sussex.

The alleged victim woke up to find Dinaj naked in her bed and no memory of meeting him or getting back to her flat.

She ushered him out of the front door and then spoke to a housemate before calling the police.

Dinaj denies raping her and said the pair had consensual sex and were both very drunk.

The woman, who cannot be identified, told officers: ‘I had never seen him before. I felt like I had sex. I don’t remember it happening.

‘I had no idea how I got back. I thought I have to do something about it because I don’t know.’

At the time of the alleged rape in the early hours of November 5, 2015, Dinaj was a Masters student at the University of Sussex in Brighton.

He now describes himself online as a derivatives trader, Bitcoin specialist and co-founder of a cryptocurrency consultancy firm.

Following his arrest, Dinaj admitted having sex with the victim both with and without a condom but claimed that she was consenting and that they were both drunk.

He told police how he started talking to the alleged victim after going out to meet friends at the Casablanca Jazz Club.

Dinaj said: ‘When we were about to leave I was talking to her with her friend. We kissed and then I realised she was a bit too drunk, she was stumbling.’

He claimed he offered to help her get home, ‘not so much obligation, more Good Samaritan’.

As he helped her and her friend to leave, a doorman intervened and asked the girls if they knew him, the court heard.

Dinaj said: ‘Maybe the doorman interpreted that as predatory behaviour. I noticed they were struggling so I asked “Are you ok?”

‘There was never any indication I was persona non grata.’

He said they went to a fish and chip shop for food before hailing a taxi back to her halls.

Dinaj told police that they kissed in the back seat before getting out and splitting the fare three ways.

‘That was another indication they were grateful,’ he told police.

He claimed that the young woman’s friend then left him to take her up the stairs to the flat.

Dinaj said that they began kissing again on the bed before she fell asleep, adding: ‘I realised nothing was going to happen so I fell asleep too.’

He told how during the night he vomited in the toilet and then went back to the bedroom to find she had woken up.

Dinaj added: ‘I sat down and started stroking her, kissing her. She kissed back. She moved to allow me to take her top off, that indicates to me there is some desire to continue. There was fondling on her behalf too.’

He said they had sex using a condom he kept in his pocket but admitted ‘she wasn’t very active’.

Dinaj told police: ‘At the same time I thought she’s really hungover, she just wants me to do all the work. There wasn’t any indication that she wasn’t enjoying it. She was very aroused.’

He claimed that when the condom broke he told her but they decided to carry on having sex until he climaxed.

Dinaj said he went to the bathroom to clean up and then left after she told him: ‘I think it is time for you to leave.’

He said: ‘There was never any freaking out, no indication that what happened she didn’t want. There was never any stress in her voice.

Dinaj said he could no longer remember the girl’s name but said he left after kissing her on the cheek.

He claimed he was ‘shocked’ when police later turned up on his doorstep to question him about the alleged rape.

Dinaj, of no fixed address but previously living in Brighton, denies one count of rape.

The trial continues.
