Ivanka Trump, Jared Kushner face lawsuit over disclosures

Ivanka Trump and Jared Kushner have been sued in federal court in Washington, DC over allegedly leaving out required information from financial disclosure documents.

Washington, DC-based lawyer Jeffrey Lovitky filed the lawsuit Sunday, naming himself as plaintiff against Ivanka Trump and Kushner, both 36, in their official capacities as advisor to the president, and assistant and senior advisor to the president, respectively.

The suit seeks to compel Trump and Kushner to amend their financial disclosures to include the allegedly omitted information.

Lovitky’s complaint alleges the couple both failed to identify assets owned by 30 investment funds they had stakes in, and that each of them should have claimed the value of and income they derived from two investment vehicles, but neither of them did. 

According to the suit, Kushner has cited that a ‘pre-existing confidentiality agreement’ prevented him from providing more detailed information at six different places in his financial disclosure report.

But Lovitky argues that excuse is not valid. 

‘The [Ethics in Government Act] does not allow a reporting individual to refuse to disclose the underlying assets of an investment vehicle, on the basis that such disclosure would violate a pre-existing confidentiality agreement,’ the complaint reads.

‘Nor does the EIGA allow a reporting individual to refuse to disclose the amount of income derived from any underlying asset of an investment vehicle, on the basis that such disclosure would violate a pre-existing confidentiality agreement.’

Lovitky also filed a similar lawsuit against President Trump in March.

That complaint argued Trump filed a disclosure during his 2016 presidential campaign that was insufficiently clear as to whether and to what extent he was personally liable for various debts shown on the document.

The suit, which is still pending, was later amended to include allegations stemming from a subsequent disclosure filed in June by President Trump.

The judge in that case has not yet ruled on a motion brought by the Justice Department to dismiss the complaint.

Kushner has already updated his financial disclosure form multiple times since it was filed in March,Politico reported. 

Kushner has said all of the additional financial information he has provided in updates was previously ‘inadvertently omitted.’

Kushner and Ivanka Trump have both been fined for filing financial reports past deadlines. 

Kushner resigned from 266 positions that had something to do with his investments in order to take his position as an advisor to the President, according to Politico.

He has not given up many of his holdings, though he has divested some.
