A Sydney man who assaulted a German woman while relaxing by the pool a luxury Bali resort will remain behind bars.

Ali Shahrouk, 38, was sentenced over an altercation with tourist Christin Steinrode Tiller at the $950 a night Apurva Kempinski Hotel in south Kuta on January 29.

Her nose and jaw was fractured in the incident. 

Shahrouk has been in custody since February 1.

Donning a face mask and red prison vest, he shielded his face from the cameras as he arrived at Denpasar District Court on Tuesday.

Shahrouk held his head in his hands as Judge Gusti Ayu Akhirnyani handed down his verdict.

‘Ali Shahrouk has been found guilty for assaulting the victim. Sentencing the defendant to 4 months and 15 days prison term,’ he told the court.

‘There is no justification for the defendant Ali Shahrouk to do his act and to escape from punishment.’

The sentence is slightly shorter than the six month jail term recommended by prosecutors.

The judge considered several aggravating and mitigating factors.

It was noted that Shahrouk’s act had disturbed the community.

However his politeness during the trial and lack of criminal record was also taken into account.

Shahrouk will serve the rest of his sentence in a Bali jail, which was reduced with time already served.

He is expected to be freed from jail  next month. 

The judge granted both the prosecution and defence seven days to appeal the ruling.

Shahrouk’s legal team have not yet decided whether or not they will appeal his sentence.

Shahrouk was lounging by the resort pool with his family when Ms Tiller confronted his brother-in-law Samer Beckdache.

The court heard she said ‘fucking p****, this is not your business’ after Mr Beckdache’s older child pushed her three-year-old down a waterslide.

The dispute escalated when Ms Tiller pushed Mr Beckdache into the pool, leading him to pull her in by the hair.

Shahrouk then slapped and punched the woman in the face.

Earlier this month, Balinese prosecutors revealed they would not pursue the maximum two-year, eight-month prison sentence. 

Instead, the prosecutor argued for a six-month term. 

Prosecutor Made Hendra Pranata charged Shahrouk for violating article 351, subsection 1 of the Indonesian Criminal Code on assault.

His lawyer Sabam Antonius previously argued his client was standing up for his children at the time of the assault.

Shahrouk previously told the court the time behind bars has already cost him his home and had left his children without their father.

‘My kid will undergo surgery in Australia and I hope that I can accompanied him. I beg to the panel to give me a light sentence,’ he said.

The father previously admitted to slapping Ms Tiller, but denied punching her. 

Both Ms Tiller and Shahrouk reported the incident to police and were urged to resolve it between themselves.

She claimed complications from her injuries cost her time at work, while Mr Antonius argued his client had exhausted all avenues to make amends outside of the court. 

Ms Tiller returned home to Germany shortly after filing the complaint.
