Bill Cosby is ‘not handing over documents’ to accusers

Bill Cosby has been accused of not handing over key documents to his victims who are suing the aging comedian of defamation over the rebuke of their claims of his sexual assault, court papers obtained exclusively by DailyMail.com reveal.

While preparing for his upcoming retrial, the 80-year-old is still in the throws of a drawn-out defamation suit brought against him by several women in late 2014.

Tamara Green was one of the first women to step forward and claim that Cosby sexually assaulted her in the 1970s, but a Cosby representative called her a liar and said she made up the story of the assault.

She sued for defamation and an additional six women have since joined the suit, but due to Cosby’s criminal trial with Andrea Constand, a judge allowed for their case to be put on the back-burner.

Now, after Cosby’s trial ended with a hung jury in June, Green’s team is demanding that Cosby stop his ‘sluggish pace’ and hand over key documents.

Green, the main plaintiff in the suit, was one of the first women to speak out about the comedian and her story accusing him of sexual assault, speaking publicly about the incident in 2005.

Court papers filed in Massachusetts on behalf of Green on Wednesday, accuse Cosby and his team of trying to ’tilt the playing field even further in his favor’ by restricting the case to only third-party discovery.

While Coby’s criminal trial was ongoing against Andrea Constand the court granted his team’s request for a stay on discovery on their behalf, meaning that Green’s team was halted in their case while Cosby was not.

Court papers claim that Cosby ‘has enjoyed the benefits of a one-sided stay, free to conduct discovery unhindered while giving up nothing to Plaintiffs in return.’

Now, Green wants Cosby to fork over documents in a timely fashion so that they can proceed with building their case.

Her lawyers also accuse Cosby of using the ‘one-sided’ advantage in his criminal trial with Constand, attempting to using depositions in their case in the criminal action.

Green, now 69, claimed that she first spoke about the incident in 2005 in an interview with the Philadelphia Daily News and during appearances on a TV show. She also gave an interview to Newsweek in 2014. 

In 2014, she called Cosby a ‘sexual predator’ and claimed he groomed her for sex in 1970 and has attacked dozens more women in the past.

Green was also an aspiring actress in her early 20s at the time of the attack and said Cosby had aggressively ‘groomed’ her for sex by promising a chance of fame.

The comedian asked if she would help him in raising money from investors for a new club he was going to open.

However, she became sick and called him informing that she would not be able to continue assisting with the investors. The comedian then invited her to lunch and told her she would feel better after she ate something.

She claims the star then gave her two pills, pretended he wanted to care for her, offered to take her home, and once there he stripped her naked, groped and kissed her before pleasuring himself sexually as she screamed for help.

She says she demanded he stop over and over but he continued his sexual assault.

Cosby eventually left and on his way out of the apartment he left two $100 bills on her coffee table, claims Green. 

Cosby is fighting for a judge to dismiss the case involving Green and the other women in the suit – Therese Serignese, Linda Traitz, Louisa Moritz, Barbara Bowman, Joan Tarshis and Angela Leslie.
