The family of a 95-year-old great-grandmother who was Tasered to death by a police officer have applauded the decision by prosecutors to appeal her killer’s sentence.

Former NSW Police senior constable Kristian White avoided jail time when he was sentenced to a two year community correction order in the NSW Supreme Court last Friday for the manslaughter of Clare Nowland in May 2023.

The great-grandmother had been armed with a knife inside her Cooma, southern NSW, nursing home when she was Tasered, causing her to fall and hit her head. 

Ms Nowland suffered from dementia and relied on a walking frame to get around. 

CCTV of her confrontation with police showed White spent less than three minutes talking to her before firing the Taser.

White later told the court he’d felt threatened by the 95-year-old. 

White was ordered to complete 425 hours of community service on top of the two year community corrections order.

The Office of Director of Public Prosecutions (ODPP) on Wednesday revealed it would appeal the court’s decision.

The appeal was welcomed by the great-grandmother’s two eldest children, daughter Lesley Lloyd and son Michael Nowland.

When asked by Nine News if he believed White deserved jail time, Michael said: ‘Absolutely. For a deliberate, inhumane act that he did, absolutely.’

His sister added the family would ‘never’ come to terms with Ms Nowland’s violent death. 

‘At 95, we could accept our mother would die but to go the way she has is just unacceptable,’ Ms Lloyd said.

‘It’s just something I’ll never ever get over.’

The siblings also shared new footage of their mother just hours before her death.

The video showed Ms Nowland enjoying a cuppa and expressing how content she was in life. 

They also spoke about their mother’s passion for her beloved South Sydney Rabbitohs NRL team and sense of adventure. 

The siblings dismissed White’s claim he was intimidated by their mother, insisting she was a kind-natured person and ‘frail’.

‘He had control of that weapon, he loaded the weapon, and he pointed the weapon and discharged the weapon … it’s a deliberate action that needs to be punished,’ Mr Nowland said.

‘We’ve just got to get a sentence that matches the crime … all we want is justice.’

Ms Lloyd added it felt as though White had ‘gone home as normal’. 

Justice Ian Harrison found White did not pose a risk to the community and showed remorse over Ms Nowland’s death.

The judge said there was ‘adequate precedent for a sentence other than full-time imprisonment in cases of wrongful death such as the present’, and found the ex-cop’s case was ‘suitable’ for a CCO.

Community Corrections advised it could ‘provide the equivalent of up to 18 hours of work per month’ for White.

His community order will expire in March 2027.
