Boss previously sued ‘for flashing his penis and making is now accused of sexually harassing another

In North’s lawsuit, which was brought against DiSilvestro separately, the woman says she joined the electrical contractor company in 2015, when she was just 18 years old, initially as a receptionist, and later as an office coordinator. 

The court document alleges that over the next several years, DiSilvestro made lewd comments to her on a daily basis, asked her about her sexual preference and remarked on her ‘hot’ and ‘amazing’ body.

The lawsuit quotes DiSilvestro as telling North, among other things, ‘your butt looks good in those pants,’ and ‘your boobs got nice and big since you had a baby.’

In one instance, DiSilvestro touched and smelled her hair after complimenting her tresses. In another, he allegedly grabbed her buttocks. 

On several occasions, the manager, who is married with children, allegedly grabbed his genitals while leering at North and asked her if she ‘likes what she sees.’ 

He also allegedly asked her repeatedly to send him photos of her naked body so he could masturbate to them, which North refused to do, and also sent her photos of himself, to which she responded, ‘eww,’ according to the complaint. 

Undeterred by North’s rejections, DiSilvestro made multiple attempts to invite her to go out with him, including under the guise of arranging playdates for their children, as seen in text message exchanges attached to the lawsuit, but the woman each time refused, fearing to be alone with him, the lawsuit alleges.

When North broke up with her boyfriend in August 2018, DiSilvestro allegedly sent her a pornographic video via text message and a GIF depicting a woman performing a sex act on a man.

Being sued by Martin and the other female workers earlier this year apparently did nothing to change the manager’s behavior toward North.

‘Even worse, he continued to sexually harass her in the middle of the Martin Litigation, while the company conducted an internal investigation into his behavior, and even after the Martin Litigation resolved,’ the complaint reads. 

North’s lawsuit also accuses the company of failing to take steps to put an end to DiSilvestro’s predatory conduct, which allegedly was widely known.

‘Knowing full-well Defendant DiSilvestro posed a threat to every female customer and employee of Defendant Krise Electrical, the company failed to institute any corrective plan, let alone one designed to stop a predator in his tracks,’ the suit alleges.  

North’s lawsuit claims that the woman had grown so anxious being around DiSilvestro that she took a month-long medical leave at the suggestion of her doctor, then quit her job altogether in early September.

The lawsuit claims sexual harassment, retaliation, assault, battery and intentional infliction of emotional distress, as well as related counts. 

North is seeking unspecified compensatory and punitive damages, plus attorney’s fees.

Her allegations mirror the claims made by Martin, a former receptionist-turned-manager, who accused DiSilvestro of making almost daily sexual advances towards her. 

Martin’s lawsuit, which has since been settled, alleged that her boss once unzipped his pants and held his penis in his hand in front of her before asking: ‘Isn’t it nice and girthy?’

He put a dildo on her desk in November last year and allegedly said: ‘I bet you could take the whole thing’.

Martin also alleged that DiSilvestro sent her a photo of his genitals from the office bathroom, saying: ‘This is what you’re missing out on’.

She claimed DiSilvestro had a conversation with her over Snapchat during work hours in October last year in which he alluded to wanting to have sex with her.

Martin also filmed DiSilvestro going on a rant about women’s rights in which he stated: ‘Women should not have the same rights as men do’ and ‘(women) need to be told what to do’.

Martin claimed DiSilvestro’s behavior was just dismissed by the company as an ‘office joke’.

The company’s human resources manager created an ‘inappropriate-comment jar’ that resulted in $1 being contributed for any inappropriate comment made in the office.

Martin’s lawsuit stated that at the end of each week, the HR manager would pick out notes from the comment jar – many which related to DiSilvestro’s conduct – and there would be enough fines to pay for lunch for the entire office.
