A baby rapist who filmed himself repeatedly sexually assaulting a two-year-old girl will have a cellmate give evidence in support of his claim that he needs special jail privileges.

Jason Daron Mizner – whose vile crimes across two countries included muzzling a toddler to stop her screaming – is currently before a tribunal claiming discrimination regarding his treatment in prison.

Mizner is serving 19 years in Queensland for 65 child-sex offences against the then toddler daughter of a girlfriend he repeatedly raped over a three-month period in the early 2000s. 

After alleging earlier this month that he was being tormented inside Wolston Correctional Centre – a claim refuted by jail officials – Mizner has received the support of a fellow inmate who will back his claims.

The Queensland Civil and Administrative Tribunal agreed the witness could testify with his identity suppressed due to his ‘fear of retribution at the hands of other prisoners’.

Mizner, a former yoga teacher, claims the prison lights and noise of other inmates at Wolston triggers the PTSD he suffers from being locked up in Thailand.

He served  11 years of a 35-year prison sentence after being caught sexually assaulting the baby daughter of a Thai woman he had befriended in the city of Chiang Mai.

Mizner was deported and arrested on his return to Brisbane, and pleaded guilty to more than 60 child crimes from the early 2000s, including more than 30 counts of rape and videotaping the assaults.

Along with the recordings Mizner made of the assaults and the names of children, police found a bag with the addresses of single mothers and plans for a child exploitation ring. 

His lawyers blamed a motorbike accident at the age of 21 for his loss of ‘inhibitions’ with children, and claimed he was beaten and tortured when in jail in Thailand.

Last year Mizner filed a petition requesting a cell of his own in the overcrowded Wolston facility because of his hypersensitivity and ‘anxiety level or traumatic mood fluctuations’.

He claimed sleep disturbances from noises and lights when cellmates used the toilet in the middle of the night.

The child predator told the tribunal he would be woken up by people ‘going about their business’ and when they ‘turned the lights on’.

He claimed were not allowed to have earplugs and that stuffing rags in his ears left them ‘scratched’ and ‘bleeding’.

However the former general manager of Wolston prison, Joel Smith, testified there was no general prohibition on earplugs and he was not aware Mizner had ever asked for any.

Two further half days of hearings into the baby rapist’s claims will proceed on dates to be set.

Mizner had sought to close the hearing and have evidence heard in closed sessions, but was denied that application.

The tribunal also refuted Mizner’s bid for a non-publication order which he said was made in the interests of the families of his victims. 

During his 2018 sentencing for his Queensland crimes, the judge said she had struggled to watch the disturbing footage of Mizner’s offences despite 30 years experience with extreme child abuse cases.

Justice Leanne Clare, who was so traumatised by the graphic footage she had delayed sentencing, said: ‘I only watched a portion and it has been a battle to get the vision of your offending out of my head.

‘I cannot imagine the horror of it for (the girl’s) mother.’

Mizner lost an appeal against his sentence in 2019 and his earliest release date will be in 2031.
