The mother of slain schoolgirl Charlise Mutten had sex and injected meth with the man accused of murdering her daughter, just hours after he allegedly killed her.

Kallista Mutten, 40, became emotional as she told a jury her daughter had earlier asked if she could ‘go with daddy’ before he allegedly shot her and put her body in a barrel.

Ms Mutten took to the witness stand on Monday to give evidence against her former partner Justin Stein in the NSW Supreme Court in Parramatta on Monday.

Stein, 33, is facing trial after pleading not guilty to murder, but has admitted to disposing of the schoolgirl’s body.

He is accused of murdering his former fiancée’s daughter at a property owned by his parents before dumping her body, which was concealed in a plastic barrel, near the Colo River area.

The girl was visiting her mother during the school holidays, and spent her time in NSW split between Stein’s family property at Mount Wilson, where she was allegedly shot and killed, and at a caravan park named the Riviera Ski Gardens in Lower Portland about 1.5 hours away.

Ms Mutten became teary during her evidence on Monday as she told the court Charlise had asked if she could ‘go with daddy’ the day police allege she was killed.

The 40-year-old walked into the court wearing a black long-sleeve shirt, navy skirt, and black heels as she gave evidence against her former partner, with her blonde hair sitting on her shoulders.

‘He said to me he had to go back up to the Blue Mountains, to Mount Wilson, to let this auctioneer lady in for his mum because she was selling antiques,’ Ms Mutten explained.

‘Charlise had finished swimming in the pool and she said “Can I go with daddy, mum?”‘

She told the court she said: ‘Yes, of course’.

Mr McKay alleges Stein was the ‘last person’ to see Charlise and had the opportunity to her between 7.16pm on January 11 and 10.06am on January 12.

The following day, the jury heard Charlise had woken up vomiting and was left at Mount Wilson, allegedly in the care of the auctioneer, while Stein travelled to pick up Ms Mutten.

Ms Mutten told the court Stein had called her to explain the situation, and was told the woman had ‘three kids of her own and she’s practically like a nurse so Charlise was in good hands’.

Prosecutor Ken McKay SC told the court Stein had sent Ms Mutten a text on the morning of January 12 which said ‘pack an overnight bag bub’.

‘To be honest, I thought he was organising us to elope… that was the surprise they had for me so I wasn’t too sure,’ Ms Mutten said.

She told the jury after Stein had picked her up from the caravan park, they travelled into Sydney where they bought methylamphetamine and injected it in a nearby park and had sex.

The pair then travelled back to the caravan park, where Ms Mutten said they were going to be ‘intimate again’.

‘He did say to me that she (the auctioneer lady) was happy to mind her (Charlise) even overnight and that we have some time to spend together,’ Ms Mutten said.

‘We were going to be intimate again, and spend the night together but I’d got too worried about Charlise so I wanted to head back to the mountains.’

They drove back to the Mount Wilson property and arrived at 8.44pm to find no lights on in the house.

Ms Mutten told the jury she didn’t find it odd until Stein said it was strange.

She said she was ‘trying to be rational’ about where Charlise was, and assumed the auctioneer lady had taken her daughter as she was unwell.

The jury heard the barrel with Charlise’s body was found on January 18, 2022, after police went to the location as a result of going through Stein’s phone.

Stein’s lawyers allege it was Ms Mutten who shot and killed her daughter on the evening of January 12, 2022.

Phone calls recorded while Stein was in prison were played to the jury earlier in the trial, where he was heard warning his mother he couldn’t tell her ‘everything over the phone’.

In the first phone call, which took place on the morning of February 5, 2022, he told Annemie Stein police had approached him asking for the location of the murder weapon and where Charlise was killed.

‘They don’t even know anything,’ he claimed in the recording.

Annemie told her son ‘No s**t, but she wasn’t killed at Mount Wilson’, to which Stein responded with ‘I know’.

The mother continued: ‘But they alleged that it was.’

‘Alleged doesn’t mean s**t, all it means is that I’m going to beat the murder charge,’ Stein replied.

Another call was played to the jury from February 10, 2022, where Stein said Ms Mutten is ‘going to get charged for everything’.

He doubled down that ‘it’s the truth’, telling his mother the police have ‘nothing’ and can’t ‘pin’ him for the murder but he ‘saw it’ happen.

The trial continues before Justice Helen Wilson.
