Corey Bohan ‘will not be prosecuted for domestic battery’

Corey Bohan will not be prosecuted for domestic violence.

The Orange County, California, DA’s office decided on Monday there was a lack of evidence that he harmed now estranged wife Audrina Patridge during an early September argument, according to TMZ.

The two split in mid September after she filed a restraining order. She has since filed for divorce and reportedly moved out of the Irvine, California, home they shared and into her parents’ house. The stars have a daughter together named Kirra, aged 15 months.

The fight took place on September 6 with Patridge claiming she was the victim of verbal abuse and that her cell phone was snatched out of her hand while she was recording Corey’s ‘rant.’

In court documents obtained by TMZ, Audrina said: ‘I am fearful of [Corey’s] temper because he cannot control his swearing and personal attacks on me, even when in the presence of our young daughter.’

Audrina also claimed that Corey shoved her while she was holding the baby, threatening suicide and ‘repeatedly harassing her while she was working.’

Now the DA says there was ‘not enough evidence to go forward with prosecution,’ according to the site. 

There certainly seemed to be an ugly situation between Corey and Audrina as well as her family last week as reported by several sources. 

On Friday The Blast shared an image of a shirtless Corey arguing with her father in the home owned by Audrina.

It has been claimed that Bohan will not move out of the Irvine, California house that she owns, as specified in their prenup. Bohan has said that her father was always in the home and wanted to fight with him, according to TMZ.

The star has asked for primary physical and legal custody of Kirra. And it was added by TMZ, which claims to have seen the divorce documents, that she does not want to pay him spousal support.

There was also an order ‘specifically prohibiting Bohan from taking Kirra to Australia’ where he comes from.

The split was a shock as the two wed only 10 months ago.

But according to a report from People, the star is having a hard time coping. ‘She’s devastated,’ said an insider.

And the brunette beauty has been leaning on her family.

‘She is extremely close with her parents [Lynne and Mark], brother [Marky] and sister and they are all supporting her. They’re a very tight family and protective of her. They just want what’s best for Audrina and Kirra.’

‘Audrina’s number one concern is for her daughter and she asks for privacy at this time,’ her rep said.

‘This is the end of a long-term relationship and she never wanted this to happen. It’s a disappointment on so many levels to say the least. It’s painful and it’s really hard.’

Adds the source, ‘This whole situation is so unfortunate for everyone. Corey has been in Audrina’s life for almost 10 years.’

They have been together romantically since 2008 and a few times took breaks. They wed in Hawaii in November. 

‘Their relationship has been tumultuous from the beginning,’ an insider told UsWeekly on Thursday.

‘They have a kid together and wanted to make it work for her.

‘Motherhood has changed Audrina in the sense that that is her No. 1 first love,’ the source added. ‘She’s enamored with her daughter.’
