Elon Musk has told Johnny Depp and Amber Heard to ‘bury the hatchet and move on’ as he denied having a threesome with her and Cara Delevingne.

An explosive new testimony claimed Musk and Delevingne had been involved in the secret relationship in late 2016.

The court documents also allege Heard’s affair with Musk began before she had officially split with Depp.

Musk told Page Six there was no truth to the fresh allegations, which claim they hooked up at Depp’s LA penthouse after Heard left him.

The claims were made in a new deposition from Josh Drew, a friend and former neighbour of Heard and Depp.

Musk wrote: ‘Cara and I are friends, but we’ve never been intimate. She would confirm this.

‘Also, I wish to confirm again that Amber and I only started going out about a month after her divorce filing. I don’t think I was ever even in the vicinity of Amber during their marriage!’

Musk then commented on the lawsuit proper in which Depp is suing his ex wife for $50million for defamation after their divorce in 2017. 

‘Regarding this lawsuit, I would recommend that everyone involved bury the hatchet and move on,’ he said.

‘Life is too short for such extended negativity. Nobody is going to say, after it’s all over, that they wished the court battle had lasted longer!’

The statement echoes that released by one of Musk’s spokesmen earlier this week which dismissed claims of an affair or three way relationship as ‘a nonsense, a soap opera,’ before reiterating a statement issued by the entrepreneur’s rep in March 2019.

‘Elon and Amber didn’t start seeing each other until May 2016, and even then it was infrequent,’ the spokesman said.

‘Their relationship didn’t become romantic until some time later.’   

Depp’s lawyers have taken depositions from dozens of former friends and associates, including Josh Drew, who was previously married to Heard’s best friend, Raquel ‘Rocky’ Pennington.

In excerpts seen by DailyMail.com, Depp’s legal team asked Drew, who lived rent free in one of the multiple neighboring apartments that Depp owned, what he knew of Heard’s alleged ménage a trois.

‘Did Rocky tell you Amber Heard was having an affair with Cara Delevingne while she was still married to Johnny Depp?’ attorney Benjamin Chew asks.

‘Yes,’ says Drew, who has since split from Pennington but says elsewhere in the deposition that he socialized with Heard as recently as last year and that she is paying for his attorney.

‘Did she ever tell you in words or substance while Amber was still married to Johnny Depp that the three of them, Amber Heard, Elon Musk and Cara Delevingne spent the night together?’ Chew goes on.

‘Yes,’ replies Drew. ‘To the specific date, I can’t say.’ 

Chew further asks: ‘So they were having a three-way affair, correct?’

‘My understanding, yes,’ Drew replies.

Heard dated Musk, 48, on and off for several years but the Tesla mogul insists they only became romantically involved after her marriage crumbled in May 2016.

Depp claims otherwise in court filings, saying that staff at the Eastern Columbia Building recall Musk visiting Heard ‘late at night’ while Depp was away filming in 2015.

He subpoenaed Musk last year for any texts, emails, letters or communications he exchanged with Heard during their marriage or anything mentioning alleged incidents of domestic violence.

Depp particularly wants to know what his ex-wife told the Space X tycoon about the May 2016 blowout fight that resulted in Heard seeking a restraining order, accusing Depp of hurling a phone at her and beating her.

Delevingne, who makes no secret of her attraction to both sexes and recently split from her longtime girlfriend Ashley Benson, has been linked to an array of stars including singers Miley Cyrus, Harry Styles, Rita Ora, as well as Fast & Furious star Michelle Rodriguez, Skins actor Jack O’Connell and model Paris Jackson. 

Depp, 57, has filed papers demanding that Musk and actor James Franco turn over any messages, emails or conversations they had with Heard around the time of their May 2016 split. 

Sources close to Depp say he ‘hasn’t ruled out’ serving Delevingne with a subpoena to find out if she has any information that could prove useful to his case against ex-wife Heard. 

‘Cara could also be compelled to give evidence – by either party,’ an insider confirmed. ‘It’s definitely a possibility. Almost anything can happen in this case.’

Depp launched his explosive lawsuit in March of last year after Heard penned an op-ed for the Washington Post portraying herself as a survivor of domestic violence.

The article did not mention Depp by name but he filed for defamation regardless, saying Heard’s ‘hoax’ allegations led to speculation he was the abuser and caused him to lose his prized role of Captain Jack Sparrow.

It was shot from the same security camera that captured pictures, published exclusively by this website, of Heard and Musk cuddling up as they took the identical elevator that same year.

Although both images are lacking date stamps, accounts from building staff now appear to corroborate claims the trio were all there on the same occasion, the day before Thanksgiving in 2016.

Concierge boss Trinity Corrine Esparza said of the trio in a 2017 deposition: ‘I saw them going up and down the elevator over and over again.

‘Cara was going up and down and then Elon and Amber were going up and down.’

Musk – who recently welcomed a baby boy with musician girlfriend Grimes – made a further cameo at London’s High Court earlier this year where Depp is also suing The Sun newspaper over a 2018 article that described him as ‘wife beater’.

The court was read a text from Depp to a friend that made an apparent reference to Musk: ‘Brother, I’m sorry to even ask but she sucked mollusc’s crooked d*** and he gave her some sh**y lawyers.

‘I have no mercy left of what I thought was love for this gold-digging, low level, dime-a-dozen mushy, pointless, flappy fish market.’

Heard’s then-legal team said Franco once lived in the same apartment complex and was simply taking the elevator at the same time.

But Depp’s lawyers hit him with a subpoena last July and want to grill him over what the pair discussed and whether she had any visible bruises.

Depp and Heard met on the set of The Rum Diary, back in 2011, married four years later – then split amid a slew of blood curdling domestic violence allegations and tabloid headlines.

Heard wrote in her December 2018 op-ed: ‘I became a public figure representing domestic abuse, and I felt the full force of our culture’s wrath for women who speak out.’

That prompted Depp to file for defamation in Virginia, where the Washington Post is based, stating: ‘Ms. Heard is not a victim of domestic abuse; she is the perpetrator.’

Heard responded with a 300-page filing of her own, cataloging the years of alleged abuse she suffered at the hands of ‘the monster’.

The Virginia case has been delayed until next year because of the Covid-19 shutdown but the London trial begins next month.
