Expelled student says woman sexually assaulted HIM

An expelled Dartmouth student is suing claiming that the woman who accused him of assaulted had actually sexually assaulted him in sadomasochistic encounter while he was blackout drunk.

The student, named only as ‘John Doe’ in his lawsuit, is now suing Dartmouth College on the grounds he was unfairly expelled and that their investigation was biased.

His claims stem from a night in August 2016, where Doe had got extremely drunk to the point of blackout at a party. When he woke up in the morning, he found his female classmate in his bed who informed them they’d had sex, the lawsuit, first obtained by Bangor Daily.

She told him that ‘things had gotten a bit ‘rough’ the previous night’, according to the lawsuit.

The woman left his room and Doe went back to sleep, but when he awoke he was ‘in pain’.

‘He noticed that he had bruises and scratches on his arms and back, that his nipple was bleeding, and that he was experiencing extreme pain in his genitalia,’ his suit stated.

She later reportedly texted him photos of bruises on her own body, saying the night had been ‘fun’.

He claimed, in his suit, that the woman had wanted to have sex with him again, which he declined. When he turned her down, he said she made a thinly ‘veiled threat’ that ‘she would make a complaint against him if he did not have sex with her that afternoon.’

Two months later, the woman went to university officials claiming Doe assaulted her.

Doe’s suit denies the allegations and accused the woman of assault and sexual assault because he’d ‘been incapacitated by alcohol the previous not, and had not been capable of consenting to sexual activity.’

He also claims that the university’s investigation into the female student’s claims were biased against men. He added that Dartmouth had conducted a sexual assault investigation against him, despite the fact the woman’s claims against him were for assault only.

Doe faced ‘immediate separation’ in March and was suspended in April 2017.

He is now suing for a reversal of the decision and to be reinstated.

The Dartmouth reports a college spokeswoman declined to comment, citing the ongoing litigation.
