Florida woman who handed her husband’s guns to the police after he was jailed for trying to run her over amid bitter divorce proceedings is arrested for theft after he filed a criminal complaint

A Florida woman who claimed her husband tried to run her down with a car is facing charges herself for taking guns from his apartment, police say. 

Lakeland Police say 32-year-old Courtney Irby is charged with armed burglary and grand theft after she allegedly entered her husband’s apartment without permission and took his guns to the station amid fears he wouldn’t do so himself.

Joseph Irby was being held in custody at the time for allegedly attempting to run his wife over following a heated argument amid bitter divorce proceedings.

Lakeland Police say 32-year-old Courtney Irby is charged with armed burglary and grand theft after she allegedly entered her husband’s apartment without permission and took his guns to the station amid fears he wouldn’t do so himself

An arrest affidavit says Irby knew her husband Irby had weapons, so she took them and turned them over to police.

Police then contacted Irby’s husband, who was then being held at the Polk County Jail, and he subsequently told officers he wanted to file charges against his wife.

Court records show Courtney Irby, who is reportedly in the middle of a divorce from Joseph, applied for a temporary injunction against her husband.

Jail records show Joseph Irby is charged with aggravated battery with a deadly weapon in the car incident. It’s not clear if he has a lawyer.

The arrest affidavit indicated the the couple had finished a divorce hearing on June 14 when they got into a heated row. 

While trying to leave the courthouse, Irby’s vehicle was allegedly rear-ended by her husband, allegedly trying to run her off the road while she was on the phone to the cops. 

‘I did not even know where the guns were located. I had to search around the apartment for them, so I could bring them to you,’ she told police, according to Fox.  

The arrested prompted fury from the public who took aim at authorities for punishing a woman apparently fearing for her own safety.  

Democratic state Rep. Anna Eskamani said on Twitter that Irby ‘should not be prosecuted for protecting herself and her family.’ 

he criticized the Lakeland Police Department for arresting someone ‘seeking help.’
