A woman claims Jarryd Hayne took her home after a boozy night out before raping her, in a civil suit filed to an American court.

Civil court documents filed in Santa Clara County Court on Tuesday accused the 29-year-old of engaging in non-consensual sexual intercourse in 2015 with a woman known as ‘Ms V’. 

The case was reviewed by the District Attorney on October 25, 2016, but was rejected due to insufficient evidence. 

The woman is a San Francisco local who works in a Santa Clara restaurant and is familiar with members of the 49ers NFL team.

She met Hayne through mutual friends after attending an NFL match between the 49ers and Cincinnati Bengals at Levi’s Stadium. An acquaintance of Hayne messaged Ms V and arranged to meet up with her group at a bar in San Jose.

The civil suit claims Hayne and other members of the team joined Ms V and her friends at the San Jose bar where they ‘ate and drank’. Ms V became ‘highly intoxicated’ at the establishment, with a friend telling police in the civil suit they had never seen her so drunk.

According to the suit, Hayne took the ‘heavily intoxicated’ Ms V to his San Jose home in an Uber, ‘despite having minimal interaction that night’. She passed out in the car during the trip due to her ‘extreme level of intoxication.’

Ms V claims in the civil suit she has no memory of how she got back to the 29-year-old’s house, but has ‘faint recollections’ of being in an elevator and walking down a hallway.

She says her next memory is of a man with a similar build to Hayne coming towards her, before the man ‘put his hands on her shoulders and flipped her around so she was no longer facing him.’

According to the suit, Ms V then heard the man say ‘no kissing’. She says she recognised the voice to be that of Hayne’s.

The claim states Ms V’s last memories were falling down on a bed. She woke up the next morning in the same bed, naked, draped in a bed sheet.

Ms V was ‘fearful’ of telling police about the incident, having heard about a number of incidents involving professional athletes where alleged victims were ‘discredited and even blamed’ for reporting sexual assaults.

She said she suffers from bouts of depression and anxiety and was concerned she would be an ‘easy target for victim-blaming.’

Two days after the alleged rape, Ms V confronted a friend of Hayne’s over the evening. The friend spoke to the rugby league star, before returning to Ms V and telling her Hayne said ‘nothing had happened’, according to the suit.

Ms V then reached out to Hayne through Instagram, asking him to explain the situation and tell her ‘why he would do that to her.’ Hayne admitted the two had ‘hooked up’, the suit states.

She says she ‘feared even more’ that she would not be believed after speaking with Hayne. 

The suit says Ms V still experiences vaginal pain from the alleged incident.

She reported the alleged rape to police in May 2016 after being overcome with the ‘anxiety’ of keeping Hayne’s alleged actions secret.

The suit also alleges incidents of gender violence, sexual battery and emotional distress and negligence.  

Following police investigations, the District Attorney, but there was not enough evidence to confirm it was non-consensual.

Hayne’s agent, Wayne Beavis, told the Daily Telegraph he was unaware of the claims on Wednesday. 

The Parramatta Eels released a statement on their star played on Wednesday afternoon, saying they were also unaware of the allegations.

Hayne sensationally left the Parramatta Eels and rugby league to join the San Francisco 49ers in 2015.

He played eight games for the team, including 17 carries for 51 yards and six catches for 27 yards. He also had three fumbles.

The team chose not to re-sign him the following season, and decided to play Rugby Sevens for Fiji after no other NFL teams approached him.

He returned to the NRL last year and joined the Gold Coast Titans. He announced last month he would be released from his record $1.2 million contract to return to Parramatta for the 2018 season.
