Mushroom cook Erin Patterson left out of her father-in-law’s will

The woman accused of fatally poisoning three of her ex-husband’s family members with a deadly mushroom-laced beef wellington has been snubbed left out of one of the alleged victims’ $2.6million will.

Supreme Court documents this week revealed Don left his estate to be split equally between his four children, Simon Patterson – Erin’s estranged husband – Matthew and Nathan Patterson and Anna Terrington.

Nothing was left to Erin or her and Simon’s children, the Herald Sun reported.

Don’s will – dated November 2, 2018 – valued his collective assets at $2.6million.

That includes a $680,000 Range Court home in Korumburra, a $695,000 North Rd unit in Oakleigh East, about $634,000 in super, $516,000 in shares, $88,000 in cash and a $30,000 campervan.

Don’s executors and two youngest kids, Nathan and Anna, were given the ability to divide the estate between its beneficiaries this week after the will was granted probate.

The status of Gail’s probate application remained at ‘further information requested’ as of Wednesday.

While the process of organising Don’s estate is underway, his official cause of death has not been determined, almost one year on from the ill-fated lunch.

The affidavit of the executor document stated ‘the full death certificate showing the cause of death has not as yet been finalised, as the death of the deceased is subject to a coronial enquiry’.

Don, 70, died in hospital one day after his wife Gail, 70, and Gail’s sister, 66.

It’s understood the three alleged victims and Heather’s husband Ian Wilkinson, who survived the allegedly poisoned meal, all suffered food poisoning before being admitted to hospital.

Erin pleaded not guilty to three counts of murder and five counts of attempted murder in May.

On top of the attempted murder charge related to Ian, Erin is accused of attempting to kill her ex-husband Simon, three times at different locations in Korumburra, Howqua and Wilsons Promontory.

The final attempted murder charge is also related to Simon, who was invited by Erin for lunch but pulled out at the last minute. 

Erin remains behind bars and is set to return to court for an administrative hearing in August.
