A New York City bar has released surveillance footage of an ‘anti-white’ attack on an actress who was beaten by up to 10 people – but it claims she instigated the fight and later spread blood on her face to make her injuries look worse than they were.
The bar has now released the footage to DailyMail.com, and it claims it shows how the Jennifer Agostini, 43, and Prendinellys ‘Brenda’ Garcia, 47, sparked three different altercations in three different areas in the lobby of the Marriott Hotel early last Sunday morning.
Last week, a judge ordered the bar to preserve the footage after papers were filed by the pair and their husbands.
A Sky Room spokesperson said in in a statement that ‘it is clear from our review of the lobby surveillance footage’ that Garcia and Agostini were ‘the clear, aggressive and harmful instigators’.
Agostini was left bloodied and bruised in the attack, and Sky Room alleges that she spread blood around her face, possibly to make her injuries appear worse than they were.
‘These women and other members of their party were hostile, aggressive, constantly cursing and physical instigators of altercations in three separate areas while at Sky Room,’ a spokesperson told DailyMail.com.
Sky Room alleged Jennifer Agostini spread blood around her face, possibly to make it look worse, and claim they offered first aid and an ambulance for the ‘small cut’ on her face
Surveillance video shows the moment she was beaten up after a verbal disagreement with fellow Sky Room customers. Legal documents claimed Agostini was attacked by a gang of 15
Sky Room claims the first incident took place at the rear lobby ATM machine, where they claim Agostini’s group ‘initially, falsely accused and allegedly assaulted another woman taking money out of her own account with her own card’.
A spokesperson told DailyMail.com their security guard had accompanied the accused woman to the ATM when she requested to pay her bill in cash. Sky Room said she was separate to Agostini and Garcia’s party.
The venue claims Garcia – wearing a floral top in the video – accused the woman of stealing her card, which was later found in Garica’s possession.
In the clip, Garcia is seen approaching the woman using the cash machine, and shortly after Agostini is seen arguing with an African American bouncer before she asks Garcia to hold her drink.
‘Ms. Agostini verbally and physically attacked this woman erroneously with what appeared to be harmful intent,’ the spokesperson claimed. ‘In our opinion, the ATM altercation in the back lobby area was entirely the fault of Ms. Garcia and Ms. Agostini.
‘Our security team immediately sought to de-escalate the situation, verbally at first, and then sought to get the entire Garcia/Agostini party out of the back lobby area towards the front door, as the Garcia/Agostini party continued to escalate the situation.’
Sky Room claims Garcia and Agostini, as well as their other party members, ignored security staff’s directives to be quiet and leave immediately so they began to move the party towards the front door to leave but that’s when the second altercation took place.
The venue said the incident involved ‘both aggressive and deliberate, cursing’.
They alleged Agostini ‘instigated a confrontation with another small party of customers in the front lobby area’ and labelled the confrontation ‘belligerent’.

Sky Room alleged to DailyMail.com that Prendinellys Garcia and Jennifer Agostini (blonde wearing black clothing, bottom right) were ‘the clear, aggressive and harmful instigators’ in the incident
Documents ordering the venue to keep the video of the incident claimed that Agostini (blonde on the left wearing black) was hurt most out of the group which included Garcia and her husband Cal

Agostini is seen returning to the fight again after being turfed outside before 4am as the bouncer mentioned in a request to courts for the video to be kept is seen outside with her
The spokesperson claims the incident escalated with ‘both parties swinging’ as security staff sought to get everyone outside the door.
They claim that even after Ms. Garcia and Ms. Agostini were escorted out the front Agostini ‘tried to instigate another fight outside the door’.
Sky Room claims that Agostini was bleeding from a cut above her right eye on her forehead from the second of three altercations and that she refused any medical help to the ‘small cut above her right eye’.
The venue claims security staff offered to call an ambulance, clean the cut – which it alleged was ‘small’ – with antiseptic and put a ‘small band aid on it, which could have stopped the bleeding’ but Agostini refused.
Agostini then refused to speak to police called by the venue, despite sticking around for a further 10 minutes, Sky Room claims.
The actress had shared an image of her bloodied face and claimed she was beaten by a gang of 10 to 15, including an African American bouncer seen in the video clip.
Agostini shared a shocking image of what her face looked like following the incident that she claims left her with ‘facial scarring and multiple lacerations’.
Documents filed by Garcia’s husband, Cal Stuart, asking a judge to order the venue to keep footage of the incident alleges that the security guard called the actress and her friends ‘white motherf***ers’, ‘dirty white b****es’.
It also alleged he yelled ‘f**k those white b****es and their money’.
There is no audio in the clip provided to DailyMail.com.
SKY ROOM ALLEGES JENNIFER AGOSTINI SPREAD BLOOD ON HER FACE
‘It is our opinion, Ms. Agostini had another agenda including seeking to spread as much blood on her face as possible for photos released to the media vs. seeking to care for her small injury at the lounge or from an ambulance our staff offered her,’ Sky Room alleged in a statement.
‘We also find it outrageous and allegedly defamatory that Ms. Agostini and her party concocted a false narrative about an alleged ‘racial’ fight with our customers and also allegedly lied saying our security staff pushed, beat or hit her. Neither is true. In fact, race was never a factor of any altercation, but Ms. Garcia and Ms. Agostini’s own aggressive and harmful actions both verbally and physically are to blame.
Sky Room claims ‘Agostini had another agenda including seeking to spread as much blood on her face as possible for photos’
‘It is an abomination the Garcia/Agostini party were not truthful about what REALLY happened. Ironically, Ms. Garcia eventually found her credit card, which was always in her possession. She and others in her party blamed and allegedly assaulted another woman downstairs in the lobby for falsely accusing her of stealing Garcia’s card.
‘Ms. Garcia, herself, forgot her credit card was still in her possession. Ms. Garcia and Ms. Agostini chose to allegedly and harmfully escalate and allegedly and aggressively cursed, hit and grabbed others, all AFTER their harmful decision to blame others for Garcia’s mistake.
‘We wish Ms. Garcia much luck with her alleged “swimsuit modeling” career and we also wish Ms. Agostini much luck with her “acting” career.
‘According to a perfunctory internet search, neither Garcia and Agostini, in our opinion, seem to be a professional model or professional actor. We look forward to reviewing evidence of them getting paid enough for either one of their professional careers over the course of many years to make a livable wage doing so.

Brooklyn Ties star Agostini has said she must now look into having surgery to alter her appearance
Actress went to Sky Room bar in Manhattan for a friend’s birthday and claims a group of 10 to 15 people attacked her and left her with lacerations around 3am
The Sky Room bar is located at the Fairfield Inn & Suites in Midtown
The documents stated Agostini had visited the venue from 11pm Saturday to celebrate a friend’s birthday and the group enjoyed VIP bottle service that cost them more than $900.
Legal documents state that after they were turfed out of the special area and moved down to the non-VIP floor, they paid up and went to the lobby.
But when a member of her group remembered the venue still held the card on which a $350 fee was held, they attempted to go back. That group member was Garcia – who is seen wearing a floral top – according to Sky Room.
That’s when a 6ft 2in man wearing a black turtle neck, identified in legal documents as a bouncer, allegedly pushed one of the women, according to the documents.
‘It was just this stampede as we were leaving. We just got rushed and assaulted by, I can’t tell you by how many people,’ Agostini told The New York Post.
According to attorney papers requesting the venue keep hold of video footage from the incident, swimsuit model, Garcia, was ‘beaten about her face, body and limbs’ and obtained ‘several scalp lacerations’.
Her husband, Cal Stuart, claimed he had come to the defense of the women but they were beaten to the ground by what he described as ‘gang members who were the bouncer’s friends’.
Stuart noted his toe had been amputated recently and claimed in the petition to preserve the video that he was thrown to the floor. Both he and another petitioner, Christopher Selletti, were beaten about the face and body according to the documents.
Agostini appeared at WinterCon in New York on Saturday, the same day as the incident
Agostini was pictured at an event for her show Brooklyn Ties in Instagram images posted three days ago
Documents claim the alleged attackers called them ‘white motherf***ers,’ ‘dirty white b****es’ and yelled ‘f**k those white b****es and their money’ as they left the venue (pictured)
The venue is touted as being ‘New York’s highest rooftop’ party venue
Stuart previously said the group did not file a police report and he was consulting his lawyers about whether to do so. He said the incident has changed the physical appearances of both women.
‘These are beautiful women and their faces are distorted,’ he told the New York Post.
Agostini appeared smiling at WinterCon in New York on Saturday, the same day as the incident. The Brooklyn Ties star Agostini claims she now needs surgery to improve her appearance.
‘I was pushed on to the ground and eight individual jumped on top of me and brutally assaulted me,’ Agostini previously claimed. ‘I have five stitches in my head. My whole eye is closed. I am going to have numerous scars on my face.
‘I’m a lead character on the series in March, and I have to now go to see numerous plastic surgeons, and I also have to go back to the concussion center to MRI my head.’
Stuart said he has a black eye and has been ‘having a lot of headaches’. ‘My whole entire body hurts,’ he told the Post. ‘They were punching and kicking me on my body.’
The legal petition states Sky Room’s liquor license could be the subject of litigation.
DailyMail.com did not receive a response from the petitioners.
A judge said Sky Room was ‘restrained and enjoined from destroying videotape of the lobby area at 330 West 40th Street … from 2:30 a.m. until 4:30 a.m. on November 24, 2019’.
A hearing is scheduled for December 19.
