New York prison guard accused of raping female inmate

A New York prison guard has been accused of repeatedly raping a female inmate, forcing her to perform oral sex on him then smuggling her the morning after pill. 

Lt. Carlos Martinez is on trial for the alleged rape of an inmate, named only as Maria, who says he attacked her repeatedly at the Metropolitan Detention Center between December 2015 and April 2016. 

The woman, 31, testified on Tuesday that Martinez, 47, made her perform oral sex on him and raped her on a desk in an abandoned office inside the central Manhattan prison.

She was incarcerated on drug trafficking charges at the time but has since been released.

On Tuesday, she wept in court as she relived the alleged abuse. 

According to AM NY, which attended the trial, the woman was too traumatized to look at Martinez in person and identified him from a photograph. 

Quivering, she told the court: ‘It was the worst thing that ever happened to me. 

‘He killed me inside.’ 

She alleges that Martinez told her not to report the alleged assaults and said she would be given more time in jail if she did.

The woman was serving a three-year sentence at the time. 

‘I didn’t want any problems. I didn’t want to be there a single day longer… He’s a man who has a certain position.

‘Who’s going to believe a person who’s a criminal versus a person who has a position, a life,’ the woman said.

She alleged that Martinez told her not to worry about falling pregnant because he had had a vasectomy.

Nonetheless, he still allegedly brought her a morning after pill in prison.

The woman said she tried to confide in fellow female inmates but that they were unsympathetic and told her she was lucky to be having sex while incarcerated. 

Martinez does not deny that the pair had sex but has pleaded not guilty to rape charges. 

His lawyer slammed the woman’s credibility on Tuesday and said she only came forward with the allegations while facing deportation to her native Dominican Republic.

She also is said to have filed a $20million lawsuit against the Department of Corrections which he said undermined her motives. 

Martinez is one of several guards from the prison who are accused of misconduct. 

Accusations against the others are being heard separately.
