The child had been sleeping in the attic at the time he ‘grabbed her by the throat and raped her,’ the Daily News reported.

The child called police to report the alleged attack around 3:15am. Petion was arrested immediately after.

Petion has been charged with strangulation and child endangerment.

A new statement released by the medic’s mother, Sarah Petion, 55, suggests her son may have been ‘set up’.

The mother said her son had been partying with friends when he went upstairs to use the restroom and saw the sobbing child.

‘A whole bunch of guys came in and attacked him,’ his mother said in a statement, according to the Daily News.

‘He said he didn’t do anything to the girl. He looked at her and asked her if she’s all right. They didn’t want to hear nothing. They just attacked him.’

Further investigation is currently underway.
