Police in Florida have closed their investigation into an alleged sexual assault at golf legend Greg Norman’s mansion, after his stepdaughter told investigators the alleged victim had bragged about her sexual encounter.
Documents obtained by DailyMail.com show the criminal probe ultimately did not result in any arrests or charges due to a lack of ‘physical evidence’ and witnesses in the Labor Day 2021 incident involving a teenage friend of Norman’s stepdaughter, Kaya Kutner, 18.
The alleged victim, then 16, had claimed she was sexually assaulted by two boys during a booze-fueled outdoor pool party at the pro-golfer’s $18million in Palm Beach Gardens property on Labor Day 2021.
Norman, 68, was out of town at the time but his wife Kirsten Kutner, 55, was at the house, although was not poolside, according to the documents.
Kaya Kutner, the 18-year-old daughter of Greg Norman’s wife Kirsten Kutner, could not corroborate her friend’s sexual assault claims in interviews with Palm Beach Gardens police, DailyMail.com can reveal
Kaya’s friend and high school classmate, who was 16 at the time, had claimed she was sexually assaulted by two teenage boys at a booze-fueled pool party at Norman’s $18million Palm Beach Gardens home (pictured on Labor Day 2021
Kutner, an interior designer, has not been charged with supplying alcohol to minors, although the girl and her parents are suing the Australian couple for negligence and contributing to the delinquency of a minor.
In videotaped interviews obtained exclusively by DailyMail.com, Kutner’s daughter Kaya, told detectives the girl had appeared to be involved in consensual three-way sex in full view of other partygoers that night.
Kaya, who was also 16 at the time, claimed the friend, one of her classmates at the fancy Oxbridge Academy in West Palm Beach, repeatedly asked if she should ‘hook up’ with two boys, also Oxbridge students who were then 16.
Speaking to detectives with both Norman and her mother present, she said: ‘She came up to me, asking if she should do it.
‘I was, like, I don’t care, do whatever you want to do. She asked me over and over … Should I do it with them?
‘The next thing I know, everyone (at the party) is telling me the three of them are out there, in a bush … I was like, that’s what’s happening right now.’
Kaya told police the alleged victim came back to her and excitedly talked about the sex acts that had just taken place.
‘She came up to me all excited,’ Kaya said, ‘jumping up and down, saying she did it, she did it, she was, like, telling everyone.
‘And after that, she hooked up with the guy I was talking to and she hooked up with another guy.’
At school the next day, Kaya told police, the victim ‘talked about it like nothing was wrong’ and did not allege she had been raped.
The victim is not being identified because of the sexual assault allegations and the fact that all parties were minors at the time of the party
In several interviews with the detectives also obtained by DailyMail.com, the alleged victim said she was too drunk to agree to the threesome and does not remember anything about it.
In a police report obtained by DailyMail.com investigators concluded they couldn’t ‘prove or disprove’ the girl’s claims she was raped by two boys at Greg Norman’s Palm Beach Gardens home
Property records show Greg Norman and Kirsten Kutner bought the property for $12.2million a little more than two years ago
The drinking of hard liquor at the Saudi-owned LIV Golf CEO’s two-acre house by high school students younger than 21 – something that is illegal in Florida – has become the main issue in the lawsuit filed by the victim and her parents earlier this year.
The action, filed in circuit court in Palm Beach County, alleges negligence by Norman and Kutner and accuses them of contributing to the delinquency of a minor for allowing the consumption of alcohol by teenagers on the property in the gated golf community of Old Palm Golf Club in Palm Beach Gardens.
That lawsuit identified the alleged rapists as M.B. and C.R.
It alleges Norman and his wife failed to fulfill their ‘duty to ensure her safety, well-being and sobriety’ and caused ‘bodily injury and resulting pain and suffering.’
Norman, 68, was out of town during the party. Kirsten Kutner, 55, was on the property but not poolside, according to police reports.
Their neighborhood features mostly multimillion-dollar homes owned by many figures of pro golf. South African players Louis Oosthuizen and Branden Grace live there as does retired Australian player-turned TV commentator Ian Baker-Finch. Former U.S. Open winners Rory McIlroy and Ernie Els both recently moved out.
Palm Beach County property records show Greg and Kirsten Norman bought the property for $12.2million two years ago.
According to real estate websites, the five-bedroom, six-bathroom, 10,000-square-foot home could be worth upward of $18million.
The alleged rape victim told police she drank straight Tito’s vodka during the afternoon party.
‘I pretty much got really drunk,’ she told the detectives, ‘and there were these two guys … And, pretty much, they brought me into this grassy area … it was kind of visible to other people … and all I remember is getting pulled in there and walking out … then my mom picked me up later … I could barely walk, I was very drunk.’
Kirsten’s daughter Kaya, above, graduated from high school in May. The alleged victim is described in the complaint as a fellow former student at Oxbridge Academy in West Palm Beach, a private school founded by billionaire Bill Koch that charges well-heeled parents more than $40,000 a year
Kirsten has two daughters from her first marriage, Kaya Kutner, 18, and Kelly Kutner, 15. Both are living with the Normans
Police reports note the victim’s mother was alarmed that her daughter wasn’t answering her cellphone and drove to Norman’s house to pick her up.
The mother described her daughter as ‘a mess’ when she found her alone and crying at the party.
The victim told police her mother gave her a Breathalyzer test when they got home and she had a blood-alcohol concentration of 0.17, more than twice Florida’s drunk driving limit. She said she was grounded as a result.
When cops asked the victim what made her believe she was sexually assaulted, she said: ‘I know if I was sober, I wouldn’t have said yes … because I had no interest in getting with either of these boys … I don’t remember any of it … I don’t remember saying yes or no.’
Norman finished second at The Masters three times and the U.S. Open twice. He won the British Open twice, in 1986 and 1993
The victim, who recently graduated from Oxbridge, said she only was told by other classmates at the party that there had been vaginal penetration and that her bikini bottoms were off when she was with the boys.
While she reported no bleeding or bruising consistent with an assault, she told police she had a ‘weird feeling’ the morning after and ‘I was told I had sex with both of them’ when she returned to school from the holiday.
She added the encounter became a hot topic on social media frequented by the Oxbridge students.
According to the police documents the two boys were alleged to have been involved in a similar incident in Delray Beach, Florida with a friend of the alleged victim. No further details were given of that case.
With a tuition of more than $40,000 a year, Oxbridge Academy in West Palm Beach is a private school founded by billionaire Bill Koch, brother of Republican bankroller David Koch.
Former President Donald Trump’s teenage son Barron was a student at Oxbridge at the time of the incident but is two years younger than Kaya and her friends and was not at the party.
DailyMail.com called and emailed officials at the school for their comments but got no response.
Family members of the alleged victim learned of the incident at the party through her brother’s social media.
The brother, now a student at University of Florida, is an Oxbridge graduate who maintained friendships with former and current students.
The brother told police in a videotaped statement he didn’t think of reporting the incident to authorities in September 2021 even though his sister told him about it.
However, he said, she downplayed the severity of the incident, just telling him ‘she had a threesome.’
‘Having a threesome and getting raped is very different,’ he told detectives. ‘She never said the word consent or rape. She definitely has decision-making issues.’
Police only heard about the allegations in April 2022, according to their investigative file.
Norman is the CEO of the breakaway, Saudi-financed LIV tour which has now announced that it will merge with the PGA tour
The victim said she came forward after walking past one of the boys in the hallway, and he ‘gave her a look.’
In closing the criminal investigation without arrests or charges, a police detective wrote he was ‘unable to prove or disprove the sexual battery allegations,’ partly because the boys refused to provide a statement about the incident.
‘This case was lacking physical evidence due to the time delay, no eyewitnesses, no video surveillance, and both (boys) through legal counsel, refused to provide a statement. This case will be inactive at this time.’
Norman has not commented about the lawsuit or the incident, including the fact teenagers were drinking on his property. His lawyer, Stuart Grossman told DailyMail.com the rape allegation was ‘fully investigated’ by police and the case was closed.
Nicknamed The Great White Shark, Norman is known throughout the golfing world as the perennial runner-up of many major tournaments who had a hard time capping outstanding performances with a win.
He finished second in The Masters three times and the U.S. Open twice. He did win the British Open twice, in 1986 and 1993.
Norman has excelled in business with his lines of golf wear and other ventures including a vineyard, a real estate development company, interior design, golf course design, canned cocktails and restaurants.
He became the public face of LIV Golf when it launched in October 2021 with a rumored $2 billion from Saudi Arabia’s sovereign wealth fund.
LIV, 54 in Roman numerals to signify the 54 holes in a LIV tournament, claimed it wanted to reinvigorate the professional side of the sport with faster tournaments 18 holes shorter than PGA, richer winnings, more stars and revamped marketing.
The tour quickly signed Phil Mickelson, Bryson DeChambeau, Brooks Koepka and Dustin Johnson away from PGA with tournament purses of $25 million, including $4 million to the winners.
For Norman, too, LIV provided a nice payday.
He is rumored to have received $50 million to take over the tour although he refused to confirm that number.
Under Norman’s watch, the rivalry between PGA and LIV quickly turned nasty, with PGA Tour suspending players who chose to play in the LIV circuit.
The move led to a lawsuit brought by 11 players, including three-time Masters champ Mickelson and 2020 U.S. Open champ DeChambeau, against the PGA Tour.
But last month, the PGA Tour suddenly agreed to merge with LIV to create a new entity yet to be named.
Norman told reporters he had no idea the merger was coming, starting speculation he was losing his clout at LIV.
