He along with two other males are alleged to have dumped her body above the Major Deegan Expressway in the Bronx.

The complaint states that it was only through an official police investigation, ‘video surveillance from different locations, review of phone records and interviews with witnesses’ that an arrest was made.

Lyric had flown to New York in from Los Angeles to celebrate her birthday at a party thrown by her sister Maya McHenry at the Dream Hotel in Manhattan on August 13.

Around 2am she vanished from the rooftop soiree and wasn’t found until the following morning.

She was unconscious, with her knees scraped, on an overpass and next to a bag of drugs in the Bronx. She later died at a hospital.

She was 20 weeks pregnant at the time of her death, although her family and friends say she had no idea she was with child.

The NYPD says they have yet to identify the mystery man who was outside of the Dream Hotel. He may hold the key to the mystery of what happened to Lyric in the hours before she died

The New York Police Department released surveillance video of a man outside the Deam Hotel in the weeks following Lyric’s death.

The NYPD tells DailyMail.com they are still seeking the identity of the mystery man who may hold a clue to what happened to her between 2am and when she was found on the Bronx overpass a few hours later.

The New York Times spoke to her sister Maya and her father, film director Doug McHenry, 66, earlier this month.

While her sister struggled to answer if Lyric had an addiction problem, her father jumped in saying: ‘I don’t think she struggled with addiction, adding ‘I think she partied.’

‘She partied like everybody else parties,’ Maya added. ‘I think it was getting a little bit out of control, but that’s just because we live in 2018 now.’

‘I don’t want this to be: black girl, drugs, something funky went on, what do you expect?’ said Mr McHenry who has expressed his unhappiness at how his daughter’s death was reported.

He was at pains to point out that she was not a celebrity wild child and her death ‘was something that could have happened to anyone’s girl.’

Her ex-boyfriend Charles Mwalimu, who began dating Lyric when they were studying at Stanford University until 2017, has alleged that McHenry had a coke addiction.

Lyric appeared on her best friend EJ Johnson’s (Magic Johnson’s son) reality show. Her ex contends that she began partying more once she was on reality TV

‘Especially when you have money and you go out all the time with people who do, some people keep that drug around more easily than others,’ he said to The Times. ‘After a while, it became a casual thing.’

‘Over time, it was kind of reaching a place where her addiction was starting to really solidify and escalate,’ he added.

Mwalimu alleges her drug use had elevated to the point that he urged her to seek counseling in the summer of 2017, but that she resisted any help.

Despite the break-up, he says they remained friends.

In early September, McHenry was laid to rest in a private funeral attended by family-friend Magic Johnson.

‘Yesterday was a difficult day as we laid to rest Lyric McHenry, a daughter to Cookie and I and best friend to EJ,’ he wrote on social media at the time. ‘We’ve known Lyric since she was a baby and shared many lifelong memories with her and her family.’
