The case against Russell Simmons’ case was dismissed with prejudice, meaning his accuser can not re-file a claim against him
Russell Simmons appears to have settled a Los Angeles lawsuit with Jennifer Jarosik, one of 16 women who have accused him of sexual assault in 2011 and 2016.
Jarosik, 37, sued Simmons, 60, for millions after she claimed he had sexually assaulted her twice. Then, earlier this month, he shot back in a court response that she sent him sexts and nude photos, after both of the alleged assaults.
According to TMZ, the lawsuit was dismissed with prejudice on Wednesday, which means Jarosik can’t file a new claim against Simmons, but it also typically indicates a settlement.
Days before the alleged August 2016 rape, the woman apparently wrote to him: ‘love to c u soon’ and ‘I emailed u love’ when she did not receive a reply back right away.
A few weeks after the alleged second attack, she wrote to him: ‘I miss you Russell… are you OK?’ and ‘Sending love,’ as well as ‘Coming to 1 a. I want to see u OK’, according to the documents. Simmons said he ignored the messages.
Phat Farm clothing creator Simmons and self-proclaimed ‘writer and yoga instructor’ Jarosik have been ‘casual’ acquaintances for over a decade, he said.
The documents alleged the woman has a ‘propensity to exaggerate,’ suffers ‘untreated mental health issues,’ and is ‘unfit to properly parent’ her young son.

Jarosik’s attorney, Perry C. Wander, told the TMZ: ‘Ms. Jarosik is a loving mother and a good parent and her parenting abilities have no relevance in this matter.’
Jarosik was suing Simmons for $5million for allegedly raping her during an interview in New York City and years later at his home in Los Angeles. Simmons and his legal team claim the large sum of money is her motivation.
The settlement terms are unknown at this time.
Jarosik first came forward to give her account of two alleged incidents in a January interview with Megyn Kelly.
She alleged to Kelly she was first raped while she was conducting an interview with Simmons. Jarosik told Kelly: ‘The first one was in May of 2011, I had traveled to New York City to interview him for my documentary film which is on women’s empowerment.’
And, she says, she considered him a friend. ‘He was a mentor, I looked up to him. I had a great tremendous amount of respect for him.’
She added ‘here is this high profile man who understood what I was trying to do to help women.
‘So after the interview, he asked my director to leave the room.’ She alleges this was at his office.
‘He asked to speak with me privately. So my director left the room. He aggressively came onto me, he started to kiss me, then he raped me.’
She told Kelly she tried to fight him off, but that it ‘happened so quickly I just froze.’

She told Kelly it happened a second time, but that incident was years later in Los Angeles in 2016.
‘I went over to his house. In Los Angeles. And we were having a meeting. And he pushed me and forced himself on top of me. And I – that was it. I left crying and I -‘
At this point, Kelly interrupts to explain her lawsuit is based on the 2016 claim because it is within the statute of limitations.
Jarosik explained to Kelly: ‘We’re filing formal reports with the NYPD and the LAPD.’
She said, later in the fall of 2016, Simmons called her out of the blue, and that she believes he was calling her because he knew other women would be coming forward.
‘He just told me when he called me the first time, he told me, “Jennifer, I think it’s time we promote something like your film. ‘Unveiling the goddess’ is what it was called”. I was shocked. I was conflicted because of what happened to me.’

When she refused, Simmons allegedly pushed her onto his bed. Jarosik then fought back, prompting Simmons to knock her off the bed, her lawsuit alleges
They spoke a second time a few days later. Jarosik alleges Simmons told her: ‘My life is being threatened. I’m deeply hurt. Everything that’s happening right now and I said “what are you going to do?” He said, “I didn’t do it.” I said – that’s when I said, but “it happened to me”.
‘And he said, “oh, my god, it did, I’m so sorry. Where was it, in New York?” And it was so – it so quickly came out of his mouth and I told him about the two times that had happened, exactly.’
She said she told Simmons about the two incidents specifically.
‘And then I told him about the two times and he said, “well, I call you a friend. And I want to help you” and he says “what do you need?” I said, “well, I – I’m trying to finish my film. Can use funding for it” and he said “I don’t have any money. But I will use my social media and I’ll make a call to a producer for you” and he did do that.
‘I did speak with a producer and then I never heard from him again.’
Kelly told her, ‘You know he will say, this is about money. She wants money, from me to fund that film. What is the reason you’re speaking out?’
Jarosik replied: ‘Right. The reason I’m here today which is so hard for me to do is for healing. It’s for my own healing.
‘It’s for my own voice. That’s been silenced and for all the trauma that I have held for all these years and for the other women – for other women to also know that they too can come forward and speak about this. Because healing can only take place – replace the trauma. When you can confront it and speak out. That’s why I’m here today.’
Jarosik’s attorney filed the lawsuit in Beverly Hills in January, which made her the 15th woman to allege Simmons was guilty of a sex crime, before a 16th accuser – who chose to remain unnamed – came forward in March, DailyMail.com exclusively revealed.
The woman, named Jane Doe in legal documents, claimed he raped her in a hotel room in Sacramento, California at an unspecified time and threatened to rape her young son if she didn’t comply.
The woman claims Simmons told her: ‘I’m going to f**k you or I’m going to f**k your son,’ Dailymail.com revealed. She is suing Simmons for $10million.

It is claimed that Simmons, 60, then hit her in the head and pounced on her. Jarosik, who was in ‘shock and fear’ at this point, lay helpless as Simmons proceeded to rape her, according to her lawsuit
Weeks prior, Jarosik recounted how she went to Simmons’ home in August 2016 for a meeting about the documentary she was making and Simmons had agreed to help.
She claimed that Simmons then hit her in the head and pounced on her.
Jarosik, who was in ‘shock and fear’ at this point, lay helpless as Simmons proceeded to rape her, according to her lawsuit.
The alleged incident left Jarosik ‘sick, sore, lame, disabled and disordered, both internally and externally and suffered from extreme emotional distress’.
Jarosik said she was prompted to come forward this year after hearing other women’s stories about Simmons.
‘The music industry and the hip-hop industry have a history of misogyny and the exploitation of women,’ Jarosik’s attorney Perry Wander told The Associated Press.
‘It’s time that they faced the music.’
Simmons said previously in a statement that the allegations in her suit are ‘absolutely untrue.’
‘I look forward to having my day in court – where, unlike the court of public opinion, I will have the ability to make use of fair processes that ensure that justice will be done and that the full truth will be known,’ Simmons said in a statement.
In the lengthy statement he said that the allegations of women against him range ‘from the patently untrue to the frivolous and hurtful.’
Simmons said: ‘These horrific accusations have shocked me to my core and all of my relations have been consensual.’
