A man who claimed to suffer from ‘sexsomnia’ has been sentenced to prison for raping his roommate’s 17-year-old friend in 2013.
Najee A’Ve was sentenced to 44 months in state prison in Yolo County, California, according to a district attorney’s office news release.
The 24-year-old, originally from Detroit, was found guilty in September of two felonies, including rape of an unconscious person and penetration with a foreign object of a person younger than 18.
The crime occurred on August 2, 2013, when A’Ve lived in Davis and was taking summer school classes at Sacramento State University. He was applying to UC Davis at the time, reported The Sacramento Bee.
Prosecutors said A’Ve had been out drinking that night and returned to his apartment heavily intoxicated.
The 17-year-old girl, a family friend of one of A’Ve’s roommates, was staying at the apartment and sleeping on the downstairs couch. She awoke to find A’Ve raping her.
She was able to ‘squirm away’ and flee to family members, who called police, prosecutors said.
‘A DNA sample was collected from the victim and analysis showed a DNA match for A’Ve,’ Chief Deputy District Attorney Jonathan Raven said.

A’Ve claimed he did not remember anything from that night and defense attorneys argued that A’Ve suffered from ‘sexsomnia’ – a sleeping-walking state during which a person engages in sex while asleep.
Judge David Reed rejected the ‘sexsomnia’ defense but found A’Ve not guilty of assault with intent to commit a sex crime on a minor.
The judge added that A’Ve is not eligible for probation, in part because he continued to drink despite his criminal conduct when drunk, the news release said.
Following his release from prison, A’Ve will be required to register as a sex offender.
