A Sydney millionaire has had his jail sentence overturned after he was caught behind the wheel of his BMW six times over the legal breath alcohol limit.

Matthew Duncan, 39, was captured on CCTV footage staggering out of his BMW before falling over in Sydney’s prestigious Woolloomooloo area in November last year.

The former executive of luxury car company Trivett Automotive Group had an eight month prison sentence overturned on Wednesday when he appeared at Downing Centre Local Court, Nine News reported.

Duncan, who recorded a breath alcohol reading of 0.342, had his eight-month jail sentence overturned in favour of a 15-month strict supervision. 

The drink driving charge was Duncan’s third.

Despite this, the Sydney professional could be back behind the wheel of a car as early as March next year.
