Former Prime Minister Malcolm Turnbull has boldly tweeted current Prime Minister Scott Morrison urging Peter Dutton’s eligibility to be referred to the High Court. 

Malcolm Turnbull made the public statement to the current Prime Minister while he was at the Winter Ball saying Dutton should be referred – like Barnaby Joyce was.

Mr Dutton’s eligibility to sit in parliament became a hot topic when Turnbull’s leadership position was under-fire .

The Home Affair Minister’s eligibility issues surrounded two Brisbane childcare centres run by Mr Dutton’s wife with constitutional rules banning any members with financial interest from holding office.

Fairfax Media revealed that a childcare company operated by Dutton’s family trust had received more than $5.6 million since 2014, prompting questions about his eligibility from the Attorney-General, who then referred the matter to the Solicitor-General. 

Dutton’s eligibility was put forward by Labor when they questioned the Home Affair Minister’s decision to overturn visa decisions by immigration officials three years ago. 

A motion to bring Mr Dutton’s eligibility to the High Court was voted down 68-69 in the House of Representatives.  

The Liberal party will lose its power if Dutton’s eligibility is referred to the High Court as he holds the seat of Dickson in outer Brisbane by a 1.6 per cent margin.
