Woman, 38, with a concealed carry permit is arrested for ‘shooting a shoplifter in the arm after he fought with the clerk and attempted to flee the store with two bottles of liquor’

A woman has been arrested in Nebraska after she allegedly shot a shoplifter as he attempted to flee a convenience store clutching two bottles of liquor earlier this month, police said.

Customer Shelby J. Jones, 38, walked into the Kwik Shop roadside convenience store on 56th and Holdrege in Lincoln on August 1, when 22-year-old Tilian J. Tilian reportedly tried to steal liquor from the store.

According to Police Chief Jeff Bliemeister, the store’s clerk attempted to restrain Tilian to stop him from leaving the store, prompting an altercation to break out between the pair.

Observing the scuffle, police say Jones, who has a permit to carry a concealed weapon, drew her handgun from her him and positioned herself between Tilian and the exit.

Bliemeister said that during the altercation, Tilian was able to break free, run past Jones and exit the store at speed.

Jones then opened fire on the apparent thief, shooting him in the back of the arm and narrowly managing to miss hitting the store clerk who ran out the store after in pursuit of Tilian. 

Officers arrived at the scene on 1:38am, after the clerk pushed a panic button behind the cash register.

‘After conducting interviews, reviewing video surveillance and collecting forensic evidence, investigators concluded Tilian was fleeing the property when he was shot by Jones,’ Bliemeister said.

Jones was arrested Friday on suspicion of first-degree assault.

Police say Tilian was clutching one of the bottles of liquor in his hand when he was shot. 

Bliemeister added that part of the training for the conceal and carry permit involves a mandated curriculum about when use of force may be applied.

Nebraska law allows for the use of deadly force to protect oneself, another or one’s property against the unlawful force by another if an individual believes it is immediately necessary. 

Tilian was treated at a hospital for his gunshot wound and was later released. Neither Jones or the clerk were injured in the incident.

Tilian has not yet been charged in relation to the attempted theft, but police are expected to cite him for the incident.
